The Supreme Court has refused to issue an order on a petition seeking the release of Bechan Jha and Teknarayan Pandey, who are incarcerated in the fake refugee case.

The bench of Justices Vinod Sharma and Abdul Aziz Muslim of the Supreme Court has dismissed the petition for direct detention against them.

Jha, who is in the Jagannath Deval Central Jail, filed a petition in the Supreme Court on January 2 to release himself from prison. The government filed a case against organized crime in the District Court of Kathmandu with supplementary prosecution against Jha, who was arrested and brought from India. Hearing about it, the district court ordered him to be sent to prison on August 2.

Jha filed a petition against that. Jha knocked on the door of the Supreme Court after the Supreme Court refused to leave. After the Supreme Court upheld the initial order, now the final decision of whether or not to leave will depend on the final decision of the district court .

Former Home Secretary Teknarayan Pandey's wife Manju Pandey, who was convicted at both the district and appeal levels in the case of fake Bhutanese refugees, also filed a writ of imprisonment for her release saying that her detention was unconstitutional. Upon hearing the joint bench of Kumar Chudal and Mahesh Sharma Poudel, the writ was dismissed.
