In the financial year 2080/81, there were 388 thousand 357 new and old cases in all courts, 58.24 percent
In the financial year 2080/81, the rate of dismissal of cases increased by 11.36 percent to 58.24 percent. Out of 388 thousand 357 new and old cases, 226 thousand 185 cases have been dismissed in the Supreme and subordinate courts and tribunals.
According to the annual report of the Supreme Court submitted by Chief Justice Prakashman Singh Raut to President Ramchandra Paudel, 227 thousand 962 cases were filed in all levels of courts in the financial year 2080/81. Before that, the number of pending cases, writs and petitions/reports in the court was 160 thousand 395. Out of them, 162 thousand 172 cases have not been settled but have been moved for the current financial year.
In the financial year 2080/81, 12 thousand 817 new cases were filed in the Supreme Court, while 28 thousand 432 old cases were pending. Out of 41 thousand 249 new and old cases, 15 thousand 521 cases have been resolved. The Supreme Court dismissed 37.37 percent of the cases. According to the Supreme Court, this is 21.64 percent more than the previous year.
Supreme Court case clearance rate was around 18 percent in 2078/79 and 14 percent in 2077/78. There were 15,146 cases in the Supreme Court that were five years or older. Such old 11 thousand 977 cases have been moved for the next year.
In 2080/81, 55 thousand 872 new cases were filed in all the 18 high courts across the country, while the number of cases that were left over from the previous year was 25 thousand 367. Among them, 56 thousand 14 cases have been disposed of by the High Court, which is a 68.95 percent clearance rate. The concession rate of high has increased by 7.10 percent compared to the previous one.
There are 1 lakh 57 thousand 4 new cases and 1 lakh 4 thousand 668 old cases in all 77 district courts, 57.95 percent of which have been resolved. This is 12 percent more than last year. The number of cases pending in the district court and transferred in the current year is 110 thousand 26.
It is mentioned in the report that although the rate of judgment in the court has increased, its implementation is not satisfactory. According to the report, the prison sentence of the previous year was 171 thousand 592 years, but only 56 thousand 954 years 8 months 8 days have been recovered.
This means that 66.81 percent of old prisoners have not been recovered. The total fine to be recovered by all district courts is 44 billion 500 million 32 million 11 thousand 124 rupees, but only 1 billion 23 million 83 million 60 thousand 690 rupees have been recovered, which is only 27.83 percent of the total.
According to the plan to deliver fast and effective justice, the district to the Supreme Court has been giving priority to the disposal of old cases. As the posts of 6 judges in the Supreme Court are still vacant, the Constitutional Bench is sitting once a week, due to which the Supreme Court has accepted that no satisfactory progress has been made in the hearing of constitutional cases.
The Constitutional Bench disposed of only 69 cases in the financial year 2080/81, compared to 300 cases that year. In 2079/80, out of 412 cases, 174 and 121 out of 436 cases in the previous year, the constitutional bench made concessions.
