The hearing of the writ against the appointment of officials in the constitutional commissions through the ordinance is being held on Wednesday.
The last hearing of the case, which has been postponed for four years by the Constitutional Court, started on January 30. Advocate Omprakash Aryal argued as the original petitioner out of 15 writs in the last hearing.
Then, senior advocate Chandrakant Gyawali was debating and after the time ran out, the case was added to the list of 'watching' and the hearing of the constitutional bench was fixed for February 21. Gyawali will start the first debate on Wednesday. "In the previous debate, I spoke on the question whether it is possible to bring an ordinance repeatedly on the same issue," said Gyawali, "I will raise the rest of my question in the next debate."
After Gyawali's debate, senior advocates Shambhu Thapa, Bhimarjun Acharya, Ramnarayan Bidari, Srihari Aryal, former Attorney General Mukti Pradhan, former Commissioner of Human Rights Commission Mohana Ansari and others will debate.
13 The Constitutional Council chaired by the then Prime Minister KP Sharma Oli recommended the appointment of 52 out of the total 61 posts of constitutional bodies through an ordinance. Prime Minister Oli dissolved the Parliament immediately after the first recommendation for the appointment.
The then President Bidya Devi Bhandari appointed 32 people on 21 January 2077 and 20 people who were recommended on June 10, 2078 based on the parliamentary rules that there is no parliamentary hearing within 45 days of the recommendation.
