The Abuse of Authority Investigation Commission has approached the Supreme Court against the decision of the special court in the case of Lalita Niwas located in Baluwatar and the embezzlement of government land in question.

  Saying that the decision of the special court is flawed, the authority has appealed to the Supreme Court demanding punishment as per the demand/demands and overturning the decision. In February 2080, the special court convicted 131 people including Deep Bahadur Basnet, the then secretary of the Ministry of Physical Planning and Construction, and Chhabiraj Pant, the then secretary of the Ministry of Land Reforms, and ruled that the embezzled land be retained in the name of the government. The Special Court acquitted the then Deputy Prime Minister and Physical Planning and Construction Minister Vijay Kumar Gachchdar, the then Land Reforms Minister Chandradev Joshi and the then Land Reforms Secretary Dineshhari Adhikari and other high-ranking people and some employees. The authority said that the decision of the special acquittal was flawed and the precedents of the court were ignored and the decision should be overturned and the punishment should be as per the demand/claim. 

On 22 January 2076, the Authority filed a case in a special court against 110 people including former ministers, former secretaries, land mafia, traders and land administration employees, and 65 people as defendants for the purpose of land confiscation. After 4 years, on February 3, 2080, the special court held a trial and found 131 people guilty and decided that the looted land of Lalita Niwas premises should be in the name of the government. The rest of the defendants were acquitted by the special court. Under the guise of a policy decision, the then 2 ministers including Gachchdar and Joshi were acquitted. The employees who were made defendants, some businessmen, middlemen were also acquitted. Many of those found guilty were sentenced to partial punishment. In particular, the authority said that the defendants were acquitted and only partially convicted ignoring the facts, evidence and established precedents from the court.

Authority spokesperson Narahari Ghimire said that he was not satisfied with the decision of the special court and appealed to the Supreme Court on Tuesday.
