The Supreme Court has thwarted the months-long efforts of the police to free an inter-caste couple from Barathwa in Sarlahi. The marriage of Satyendra Kumar Ram (Chamar) of Barhathwa-10 in Sarlahi and Neha Rauniar of Barhathwa-5 has been legalized by the Supreme Court.
Police machinery was used to bring Satyendra and Neha who ran away from home to Mumbai, India on July 25. Neha's family filed a complaint against Satyendra on charges of body hostage and kidnapping, while the police filed a case for the crime of child marriage. But the bench of Supreme Court Justices Hari Prasad Phuyal and Balkrishna Dhakal ruled on Sunday that the attempt to separate the couple as they had reached the age of marriage on the basis of birth registration was wrong. The Supreme Court has also ordered Neha to be handed over to Satyendra.

Then the police arrested Satyendra and submitted him to the Sarlahi District Court as they were living in Lalitpur. Neha was entrusted with Maiti. In the meeting of the House of Representatives on Thursday, MPs from the ruling party and the opposition also raised questions that there was an excess in the involvement of the Home Minister and the top police officer due to the fact that Satyendra and Neha had an inter-caste love marriage. They said that it was wrong to register a case of child marriage when they had already registered the marriage.
Satyendra and Neha left home for the first time on July 25 to get married. At that time, Neha's father Surendra was in Delhi, India for treatment. As soon as he heard the news of his 'missing daughter', he immediately returned to Nepal and his uncle Manoj submitted an application to the District Police Barhathwa on July 29 and to the District Police Office Malangwa on August 2 for a search.
While inquiring with the villagers, Surendra found out that Neha had gone with Satyendra. They then pressured Barathawa police to interrogate Satyendra's father Indal Ram and mother Geeta Devi. Satyendra's father Indal, working as an assistant inspector of police, asked for a week's time and handed over Neha to her family through the police office on August 11.
According to Sarlahi police chief SP Ravindra Singh, Satyendra and Neha walked again on October 10. Then on October 8, Neha's father Surendra went to the district police office to lodge a complaint against Satyendra and 9 other people on the charge of body hostage and kidnapping.
The police refused to file a complaint on the charge of kidnapping, saying that even though they were not old enough to get married, they left on their own accord. At that time, Satyendra had just turned 20 and Neha was only a few days away from turning 20.
After the police refused to file a complaint for the crime of kidnapping, Surendra filed a complaint against Satyendra, his father Indal, mother Geeta and uncle Raju for the crime of child marriage. The complaint was registered by the police only on October 25. "When the girl's father filed a complaint with proof that his daughter was missing, married before she reached her age, there was no reason not to register it," SP Singh said. According to him, an attempt was made to find the children. After investigating the complaint, the police submitted the missile to the district attorney's office on December 2.
After both Satyendra and Neha left the house for the second time, Surendra filed a search warrant in addition to Sarlahi, Kathmandu Valley Crime Investigation Office Teku and Police Circle Gaushala. According to Satyendra, two Nepalese policemen along with the Indian police had reached the place where they were staying in Mumbai. Later it came to know that the Nepali policemen were Rugam Kunwar and Indramani Pokhrel. They have been bringing fake papers from Mumbai. On the basis of that document, they tried to take us from Delhi to Kathmandu by cutting our tickets,' he said, 'After we told the police at the airport that they were trying to take us by making fake documents, the Nepalese police ran away.' "I went to India for work," he said, "I did not go to arrest them." There was false propaganda. I have reached India in connection with various issues.'
Deputy Inspector General of Police Dinesh Kumar Acharya, the spokesperson of the police headquarters, also claimed that the police did not go to India to arrest Satyendra and Neha. Neha and Satyendra had a 'court marriage' at the Kapilvastu District Court on 3rd December. After that both of them were living in Tikathali in Lalitpur. Satyendra's mother Geetadevi also lived there. But before the marriage, Satyendra was accused of absconding as a child marriage complaint was registered at the Malangwa District Police Office.
Based on that, Neha's father Surendra used the team of Kathmandu Valley Crime Investigation Office again on December 16 to cook her. On the same day, the police arrested them from Lalitpur Metropolitan Municipality-6 Motichowk. At that time, the police assigned Neha to Maiti's side.
The police took Satyendra to Sarlahi on the same day. Sarlahi police submitted Satyendra to the district court on December 17, said SP Singh. "We have kept him in custody for a few days," he said, "There has been no torture or abuse on Satyendra here. He also said that in the
child marriage case, the court demanded 30,000 bail from Satyendra on December 19 and ordered him to be released on the date. On the other hand, Neha, who was with her family, was asked to submit a petition for canceling the marriage registration in the District Court Sarlahi on December 29.
Satyendra filed a writ of imprisonment in the Supreme Court on December 22 saying that even though he was released on bail, he could not meet his wife. Hearing the same writ, the Supreme Court ordered on January 20 to handover Neha to Satyendra based on the evidence that both of them are adults and the statement that they have agreed to live with each other. According to Surendra, in the closed session of the court, Neha told the judge that she would live with Satyendra. "After that, I came after leaving my daughter there," Surendra said.
