There is a constitutional provision that if the ordinance is not accepted by both houses of the federal parliament, it will automatically become inactive.
There are 59 MPs in the National Assembly. A majority vote of at least 30 MPs is required to pass the Ordinance. In the National Assembly, there are 29 MPs including 16 from Congress, 10 from UML, 2 nominated and 1 from LOSPA in favor of the Ordinance. In the opposition, there are 26 MPs including 17 from the Maoists, 8 from the United Socialist Party and 1 from the Rashtriya Janamorcha.
There are 3 MPs of Jaspa Nepal yet to decide whether to accept or reject the ordinance. If JSP Nepal decides to accept the ordinance, there will be a majority in the ordinance, if JSP stands in favor of rejecting the ordinance, there will be equal 29-29 MPs on both sides. In such a case, the Speaker of the National Assembly, Narayan Prasad Dahal, has to vote. Dahal is an MP nominated by the President. He was the leader of the Maoist center in the past.
