The dispute between the leaders whether to hold the 15th Congress 084 before or after the election has started to surface. According to the law and the constitution, the convention must be held within 5 and a half years at most, but the controversy over the date of the congress convention has increased after the leaders of the founding party put forward a proposal to extend the tenure of the working committee until after the 084 election, even if it is done by amending the constitution or merging the party with another party.

Congress leaders argue that the congress convention should be held only after the general election, with the argument that the conflict within the party will have an impact on the 084 election. 

Congress was in a constitutional crisis in 272 during the 13th Congress. In the constitution at that time, there was a provision that "parties should hold the election of the central chairman and office bearers within five years", adding 6 months to the new constitution and all the parties came together to remove the difficulties of the Congress. 

The Congress Constitution has fixed the tenure of the Central Working Committee for 4 years. Sher Bahadur Deuba was elected as the chairman of the 14th Congress in November 2018. According to the law, the convention should be held by November 2018. But in the statute, provision has been made to extend it by one year. In this way, it seems that the convention should be held within November 083. 

According to the provisions of the constitution regarding political parties, an additional 6 months may be available. Clause 4 (b) of Article 169 of the Constitution has made a mandatory provision to hold a convention within five and a half years. According to this calculation, if the 15th Congress cannot be held within May 084, the question of constitutional crisis will arise on the Congress party itself. 

BP's son Shashank Koirala, who is also a former general minister, is in the forefront of proposing that the convention should be held only after the parliamentary elections of 084. Shashank has been constantly maintaining this opinion in the public forum and media. Brother Shekhar Koirala and his party leaders have taken the expression of Shashank who supported President Deuba in the 14th Congress as meaningful.

A central member said that some officials and members of the Deuba party are looking for a way to push the congress after the parliamentary elections. After central member Narayan Khadka, who is also a former foreign minister, brought this issue up for debate in the last parliamentary party meeting, there was confusion within the Congress regarding the date of the convention. 

Leader Shekhar Koirala accused the establishment party of trying to put the entire party at stake for the prime minister's chair. "They are trying to weaken the Congress by pushing the convention after the parliamentary elections. Those who are speaking like this are speaking from a weak state of mind," he told Kantipur. A regular convention is possible within 082, but why is it being said after the election of 084?'

Some office bearers and central members close to the chairman are insisting that the date of the convention can be extended after the merger with a small party according to the provisions of the Act on Political Parties. In the case of the new party formed after the merger of the two parties, another five years time is available for the convention only. General Minister Thapa said that no alternative will be sought to reduce the Congress to zero. He claimed that the convention could be held before the 084 elections. The constitution says to hold a convention within five and a half years. How can it be extended after it is specified as five and a half years at the most?,' he said to Kantipur, 'Some friends have easily come up with the idea of ​​mixing and adding a party. That means creating a new party, new means starting from scratch. It is unimaginable that Congress will start from zero again.' 

General Minister Thapa said that it is not possible to think about the matter that is not given by the constitution. What the constitution does not give, the law does not give after the constitution does not give. To imagine such a thing is to lead the Congress to an accident,' he said, 'The convention should be held by November 2018, otherwise we have no other option but to hold the convention before the 084 election.' Bar Association President Gopalkrishna Ghimire said that the convention cannot be pushed beyond what is provided by the constitution. Periodic elections are a beautiful aspect for any democratic party even in its internal life. Such questions were raised before, but the convention has been held within the time frame, it will be beneficial for the Congress to hold the convention within the time given by the constitution and law. Before the new constitution came into force on October 3, 2007, it was stipulated that the parties should hold the election of the central chairman and office bearers within five years. The 12th Congress of the Congress was held from 1st to 5th October 2017. According to the constitution, the Congress had to hold a convention within the first week of October 2017. However, since the parties are in the final homework of constitution making, the work of adding 6 more months to the proposed five-year period was done in the new constitution. 

Congress held its 13th convention in February 2012 by keeping an additional 6-month provision in the constitution so that the party would be in crisis at that time, General Minister Thapa said, "Even now we have no other option but to hold a convention before the 2084 election." 

According to an official of the founding party, Chairman Deuba wants to hold a convention only after he becomes the prime minister. According to the agreement with UML, he will become the Prime Minister in July 083. The chairman has no ambivalence about the provisions of the constitution, but he thinks of holding a convention only after he becomes the prime minister. His desire is to become the prime minister in July 2008 and hold a convention after that,' said the official, 'but some people around him are talking about a convention that cannot happen, trying to create confusion.' According to the constitution of the party, Deuba will be separated from the leadership from the next convention due to the provision that he cannot be chairman for more than two terms. Although he has left the leadership of the party, some people understand that he wants to stay at the center of power politics. For that reason, he has speculated that in the 2084 election, the convention will be held only after he distributes the tickets. From the central officials to the officials of the federal constituencies, they do not want to hold the convention within time. "Many people feel that they could have said farewell by distributing tickets in the Sakvar 084 election," said a central member, "and that's why the party has not been able to prepare for the convention." 

Central member Khadka argued in the parliamentary party meeting that it would be beneficial to hold a convention after the election, even if it is done by amending the constitution rather than holding a convention before the election. Khadka told Kantipur, "I have put this matter for a theoretical debate rather than a proposal. If the constitution could not hold a convention within five years by adding one year, and if 6 months were to be added according to the Katham constitution, then the time for the general election and the convention would not be from 5/6 months." In that case it affects us greatly. Jithar's dissatisfaction grows in the party. That's why I have said that there may be an option to amend the constitution.'

Shashank, who hopes to become the chairman with the support of Deuba, has brought the issue of shifting the convention to the debate since four/five months. He argues that the general election should be held after the convention as the issue of victory in the convention will affect the general election. "There should be a convention within 082, since that won't happen, it's best to hold it after the 084 election," he said a few days ago at a program in Chitwan.

Central member Nainsingh Mahar says that a democratic party like the Congress should not go beyond the constitution and the party constitution to find an alternative. "The party runs according to the constitution and the country according to the constitution, Congress runs according to the constitution. You should not think of an alternative to the constitution and the law," he said. "Looking for an alternative to the constitution and the law will not help the party, nor will it help the democratic system. Only those who trample the constitution will get help. Therefore, it should be done on time by following the constitution and by-laws.
