Negotiation committee to settle Pathibhara cable car dispute

The Union Government has constituted a negotiation committee to resolve the dispute arising out of the cable car construction in the Pathibhara area. The committee formed under the coordination of Home Ministry Joint Secretary Prem Prasad Bhattarai has representatives from Ministry of Federal Affairs and General Administration, Ministry of Culture, Tourism and Civil Aviation and Ministry of Urban Development. But the Ministry of Home Affairs has not revealed the name of the representative of that ministry.

The Ministry of Home Affairs had requested the Ministry of Federal Affairs and General Administration to form a negotiation committee a few days ago. But the Ministry of Federal Affairs sent a letter stating that this problem is a multilateral issue and peace and security management should be done by the Ministry of Home Affairs for coordination and facilitation with other relevant agencies.

Then a negotiation committee was formed from home. In a statement released on Sunday by the spokesperson of the Ministry of Home Affairs, Ramchandra Tiwari, mentioning that the negotiation team will start work immediately, the agitating party has also been requested to withdraw the announced program and solve the problem through dialogue. 

The agitating party is adamant that they will hold talks only after the release of three arrested persons, including Pradeep Maden, and the suspension of cable car construction. Earlier, they also demanded that the armed police should be withdrawn from the construction site, but recently this demand has not been maintained. 

After the local administration is not ready to stop the construction of the Pathibhara cable car and release the three arrested people, the 'No Cable Car Movement' has been extended. The traffic shutdown that started from Taplejung on January 15 has spread to nine districts in the east. Clashes also took place between police and protestors on Sunday in places like Damak in Jhapa, Itahari in Sunsari. 

Koshi Province Police Spokesperson SP Deepak Pokharel said that 14 protestors, 8 from Jhapa and 6 from Sunsari, were detained by the police on Sunday. He claimed that the protestors in Damak fired one round in the air after breaking the windows of the police vehicle. The agitating group has not allowed two-wheeled vehicles (motorcycles) and three-wheeled vehicles (tempos) to run in Taplejung, Panchthar and other districts. The effect of the traffic stop has also been felt in Ilam, Jhapa, Morang, Sunsari, Dhankuta, Terhathum and Sankhuwasabha.  A discussion was held at the district administration office from 1 pm to 6 pm on Sunday regarding opening and negotiating the

bandh. Representatives of political parties affiliated to the agitating group, head of Fungling municipality, Pathibhara Yangwarak, Meringden, Paktanglung, Mikwakhola rural municipality chairman, representatives of political parties active in the district, industry and commerce association and other organizations participated in the discussion.

Bhakta Khebang, central vice president of the protesting National People's Liberation Party and coordinator of the protest committee, said that the protest would be postponed if the three people in police custody were to be unconditionally released and the construction stopped until the negotiation period. "We will immediately suspend the program of bandh/strike by stopping the work of the cable car until the arrested friends are released and the talks are held."  In the

discussion, from Fungling Mayor Amir Maden, all village chairpersons and heads of political parties asked the local administration to release the arrested workers. "In some matters, the state should exercise restraint and take a step back for the convenience of the people," said Rajan Limbu, chairman of Paktanglung Rural Municipality, to the chief district officer, "let's leave those under police control, let's not drive dozers to the construction site until the negotiations are over." President Yukhamvir Hangam also requested the administration to release those arrested. It is a problem for people to reach the hospital, the risk of further conflict has increased, the community has started to divide. Therefore, let's leave the arrested and return the closure," he said. Chief District Officer Netra Prasad Sharma said that the arrested cannot be released until the 22nd because the court has extended the deadline. "We agree to make the case flexible," he said. 

He said that since the local administration's job is only to provide security, he does not have the right to 'stop work or do it'. After that, the participants, including the public representatives, who were angry, expressed their anger towards Prazia Sharma saying, "If you don't follow our advice, why did you call us?" Congress leader and President of Pathibhara Campus Board of Directors, Sila Ijam, warned that the administration should take responsibility if the cable car dispute reaches the community and causes further damage. 

There has been a dispute since 2075 between building a cable car in Pathibhara and not allowing it to be built. There was a clash between the security personnel and the police in Kaflepati last January 12 when the excavator started digging the ground where the lower station of the cable car is. Three protestors and 21 security personnel were injured in the clash. After the clash, the agitating party has stopped the traffic in Taplejung, Taplejung to Panchthar, Mechi highway through Ilam to Charali in Jhapa and Tamor Corridor from Taplejung to Panchthar to Mulghat in Dhankuta.

The MPs of Koshi State Assembly also raised questions about the clashes that took place in Kaflepati's Baludanda. They requested the government to hold talks with the protesting groups immediately. Khagensin Hangam, Minister of Industry, Agriculture and Cooperatives of Koshi province, elected from Taplejung 1 (2), requested the peace and political negotiation committee formed by the provincial government for talks. A committee headed by Economic Affairs and Planning Minister Ram Rana decided to call for talks. But the committee has not sent correspondence to the protesting parties till Sunday evening. 

Chief District Officer Sharma said that he had sent the contact number of the leader of the protesting organization to the committee. "I have informed the state and union government about every activity of the district," he said in the discussion on Sunday. 

A 2.7 km long cable car is being built from Fungling Municipality-10 Kaflepati to the end of the temple targeting the Pathibhara temple. The protesting party has been demanding that Pathibhara Mukkumalung should be kept in its original state as it is the heartland of the Limbu community. Pathibhara Mukkumlung Cable Car Pvt. Ltd. led by Chandra Dhakal, President of the Federation of Industries and Commerce, started the construction of the cable car after obtaining a construction permit from Fungling Municipality.
