In the ordinance proposed by the government on Friday night to address various issues, there is also the issue of amending the Local Government Operation Act, 2074 to solve such problems at the local level. Due to litigation in various municipalities, when both the chairman and the vice chairman or the chief and the deputy chief were suspended at the same time, there was a problem of who would lead the municipality.
In the Local Government Operation Act, the work, duties and rights of the vice-chairman or deputy chairperson are prescribed to take over the duties of the chairperson or chairperson in the absence of the chairperson. However, Kali Prasad Parajuli, spokesperson of the Ministry of Federal Affairs and General Administration, said that problems have arisen in some municipalities in recent days as there is no provision in the law for what to do if the position of vice president or deputy chief along with the chairman or chief is vacant for any reason.
"There is a problem of how to perform the work in the municipality where both posts are vacant," he said, "that is why the need to amend the law has been felt." According to him, everything will be clear only after it is published in the gazette.
