The Executive Director of Nepal Electricity Authority, Kulman Ghising, has given an answer to the Ministry of Energy, Water Resources and Irrigation that the cancellation of his appointment is not legal.
Responding to the explanation asked by the ministry on December 22, Ghising said on Sunday that canceling his appointment would not be legal. 'Why not cancel your appointment ?' In response to the question asked by the Ministry, Ghising said, 'I also request that the matter of canceling the appointment letter is not legal in itself when the results and work progress have been achieved by achieving 98.99 percent marks as per the target specified in the performance report .
Ghising has clarified that there is no legal basis to cancel the appointment letter on the basis of not filling in the performance details . "The performance statement is basically related to the executive director's incentive allowance and due to the regular and emergency workload and urgent work of the organization, it took some time to submit the statement, so the performance statement cannot be evaluated and cannot be a basis for termination of service. '
Ghising also reminded the ministry that his tenure is 4 years. Ghising has also written that he is appointed by the Council of Ministers and does not have the right to terminate his appointment by other agencies. Regarding my appointment as the Executive Director of Nepal Electricity Authority for a period of 4 years in accordance with the decision of the Cabinet of Nepal Government dated 25 July 2078, regarding the termination of the appointment as mentioned in the said letter, based on the institutional interest and significant work progress and the above-mentioned facts, grounds and considerations. There is also a request that others do not have the authority to take any action and decision,' Ghising replied.
