The Biratnagar High Court has issued a warrant to investigate the fraud case against Anil Kumar Pokharel, the personal secretary of Public Accounts Committee chairman Rishikesh Pokharel and UML Morang district committee member.
The high court has issued a mandate in the name of District Police Office Morang to register a complaint against Pokharel, who has succeeded in preventing the police from registering a complaint of fraud under the guise of political power.
The bench of High Court Judges Rajyalakshmi Bajracharya and Suryanath Prakash Adhikari filed a complaint against Anil Kumar Pokharel and ordered District Police Office Morang to investigate according to law. The order was confirmed on December 11.
In Pokharel 2079 House of Representatives and State Assembly elections, candidates were recommended from Kosi State Assembly Constituency No. 2 of the House of Representatives Constituency No. 2. Although Lilabalab Adhikari got the ticket from the said constituency, Anil Pokharel and other leaders from the district were also recommended.
Rishikesh Pokharel was elected MP after the November 079 House of Representatives elections. In August 2080, Rishikesh was elected as the Chairman of the Audit Committee. Anil, who did not get a ticket as a member of the state assembly, is the personal secretary of Rishikesh Pokharel.
Boualal Chaudhary's daughter's name will be taken out in the entrance of MBBS and Anil Kumar Pokharel said that he will arrange accommodation in the hostel. 38 lakh 80 thousand rupees has been taken in the petition filed in the court. Chaudhary wrote in the application that Pokharel called him saying that he will settle the account on 9th July 2079 when that is not enough. After Pokharel made the document, Chowdhury reached the area police office Rangeli demanding to cancel the loan deed of 5 million and return his amount of 38 lakh 80 thousand and to take legal action . The police, who understood the letter from the post office, did not proceed with the fraud investigation against Pokharel. After that, he reached the Biratnagar High Court to request a warrant in the name of the police and the lawyer's office to investigate the fraud against Pokharel.
The police claimed that Boualal had not filed a complaint even in the court and that no complaint had been filed even from the post office. Assistant Judge Ramuna Raut, who appeared for the hearing in the High Court on behalf of District Police Office Morang, presented the claim. The district attorney's office also insisted that Chowdhury did not submit the application.
The High Court said that Chaudhary's evidence of reporting to the police was presented in the court itself. The court showed the police a copy of the postman's book. "It appears from the postman's book received from the Directorate of Posts, Biratnagar, that the letter of registry number 'RD780470582NP' sent by this petitioner to District Police Office Morang on July 18, 2079, with the complaint of receiving criminal benefits by fraud, was received by District Police Office Morang on July 19, 2079. The court has commented that the answer of District Police Office Morang cannot be considered reasonable. Based on the information received, the High Court has asked the police to act according to the law, saying that it is not possible to live without completing the procedure prescribed by the law. "There is no basis and reason why the complaint of the petitioner should not be registered and the investigation should not be conducted as the petitioner's complaint has not been received. In the case of non-fulfilment of legal duty or refusal or delay, the remedy of injunction is necessary against the concerned public official or office to perform that duty or to discharge the legal duty. If necessary and appropriate treatment is requested to discharge the duty and if his demand is justified and in accordance with the law, for the necessary action and disposal of the complaint filed by the petitioner in accordance with the law. It appeared that a warrant should be issued in the name of the district police office Morang.
The high court told the police to register the complaint and act in accordance with the law, therefore, the complaint application sent by the petitioner Boualal Chaudhary by post dated 19 July 2079.
