Section 64 of the Bill to amend certain Nepal Acts brought to withdraw political cases

The government has withdrawn the proposed amendment to the law to withdraw any cases of crimes committed under political cover. Section 64 of the bill made to amend some Nepal Acts to amend Section 116 of the Civil Criminal Procedure Code, 2074 has been withdrawn.

In the Sunday meeting of the Law, Justice and Human Rights Committee under the House of Representatives, Law Minister Ajay Kumar Chaurasia informed that section 64 of the bill had been withdrawn. Before the discussion on that section, Minister Chaurasia and Udayaraj Sapkota of the Ministry of Law informed that the decision to withdraw has been made.

Section 116 of the Code of Criminal Procedure, 2074 listed non-returnable cases. By amending the said section, the government was going to make arrangements to withdraw any pending cases against political party leaders and activists.

It was written in section 64 of the government's bill that, 'regardless of what is written in section 116, if any political party or group disagrees with the country's political system and conducts violent activities, such party or group shall be subject to the constitution and existing laws to come to the mainstream of peaceful politics. With the commitment to carry out peaceful political activities, there is an agreement between the government of Nepal and such parties or groups through an agreement of a political nature to withdraw the cases filed against the leaders and activists of such parties or groups in accordance with such agreement. Whatever case is pending in the court of any level, withdrawal will not be hindered.' 

Minister Chaurasia said about the reason for withdrawing that section, 'This bill was brought in section 64 to amend the Criminal Procedure Code, because it was said to withdraw it from the committee itself, so the decision has been taken now . This decision has been made according to the commitment made by the previous minister. What has been withdrawn by the previous minister has been withdrawn.' Minister Chaurasia said that because the people also opposed the

bill and there was also opposition in the parliament, this section is going to be withdrawn. "Nepalese living outside and people from here also protested . It has to be withdrawn as it affects serious cases of human rights violations. If there is an agreement between the political parties about what else to do, it should be returned as soon as possible.'

Ministry Secretary Sapkota  Dhanraj Gurung, the then law minister who presented the bill, said that it was the decision to withdraw it. He said that it has been decided to withdraw this section now that the cases that can be withdrawn have been withdrawn and new laws will be introduced for the rest. 

MPs expressed their displeasure that the clause was withdrawn without informing the parliamentary committee.
