The police head office has formed a committee to investigate the incident where the photo of Ravi Lamichhane, who is in police custody on charges of co-operative fraud, was published. A four-member committee has been formed under the leadership of Senior Superintendent Mukund Marasini, Head of Gandaki State Training Center of Police.
Earlier, Home Minister Ramesh Akhtar had instructed Inspector General of Police Vasant Kunwar to publish the photos and investigate the responsible police officer.
A debate started on Thursday as to how the picture of Lamichhane sleeping in a detention room wearing a silk robe was published on social media on Wednesday. The RSVP blamed the police for the photo being released. Lamichhane's aide Deepak Bohora posted a picture of Lamichhane Kaski sleeping in police custody on Facebook on Wednesday night.
There is a limit to doing injustice. To whom would Kaski police have screenshotted the CCTV photo of Ravi Dai sleeping in the detention cell?,' he asked, 'and for what purpose was it made public? How much is this photo worth? If justice is not dead, someone will have to pay the price.' Less than 12 hours after Bohora posted the photo of his chairman on Facebook, Nicholas Bhusal, a doctor who described himself as a 'well-wisher' of the RSVP, took responsibility for publishing the photo.
He said that the picture was taken last Saturday at 4 pm and posted on Facebook on Tuesday. He said that he went to the detention center to meet and encourage Lamichhane that day. He said that he took the picture from the TV screen where the CCTV footage was being displayed while he was sitting in the control room of the district police office.
'I took a photo on the CCTV monitor after the meeting, I did not take it inside the custody, I took the footage of the CCTV camera. I did not think otherwise, but I take responsibility for the mistake and apologize.'
Bhusal has also said that he is ready to face punishment saying that it was a mistake to bring out the picture. "I did not intend to blame anyone or have bad intentions," he said, "Please do not get confused." I went to understand the health situation and to offer encouragement, not to go viral. I took a photo to explain how they are sitting.' As soon as you enter the district police office premises, the police keep mobile phones of common people near the gate. However, Bhusal claimed that he was not asked for a mobile phone. He has insisted that he took the photo in front of the police and that the footage of the photo taken by him should also be with the police.
District Police Office Kaski issued a statement on Thursday saying that it has drawn serious attention to the publication of the photo. It is mentioned in the statement that unauthorized photos were disseminated on various social networks in such a way that the publication of photos from Bhusal's Facebook page will affect the professionalism of the police in a way that negatively affects the factual investigation of cooperative fraud, organized crime and money laundering crimes.
It is said in the statement that any person involved in unauthorized publication and transmission of content in violation of the prevailing cyber crime law will be investigated and prosecuted according to the law. District Police Office Kaski spokesperson DSP Vasant Kumar Sharma has said that the incident is being investigated.
In the preliminary investigation, it is known that Bhusal published the photo, but it will be clear only after further investigation, said DSP Sharma. "After the investigation, we are discussing which law to take according to the need," he said, "two-three laws seem to be attracted." He said that it was arranged that it would not happen. Article 298 of the Civil Crimes Code states that no one shall violate the confidentiality of any information, information or correspondence contained or transmitted through electronic media, or shall not transfer or cause to be transferred to anyone in an unauthorized manner.
A person who commits or causes such an offense shall be punished with imprisonment for up to 2 years or a fine of up to 20,000 rupees or both. If the photo is published in this way, it seems that the Personal Privacy Act, 2075 and the Electronic Transactions Act will also be attracted.
A security expert says that the release of custody photos is mainly a weakness of the police and it may also affect the investigation. Former DIG of Nepal Police, Hemant Malla, said that in terms of security, the publicizing of the pictures inside the custody shows the weakness of the security system and will also affect the ongoing investigation.
He said, "The fact that VIPs are treated differently in detention affects the psychology of common prisoners." In some cases it also affects research.'
