The contempt case against 'Sidha Kura' online, its publisher Yuvraj Kandel and executive editor Naveen Dhungana for contempt of court by preparing 'fake' audio content is going to be decided by the full bench of the Supreme Court. The Supreme Court bench of Justices Kumar Chudal and Vinod Sharma issued an order to send the case to the full bench on Wednesday.
On the petition of Supreme Court Sub-Registrar Govinda Prasad Ghimire, a contempt of court case was filed against 'Sidha Kura', its publisher and executive editor. The order made by the bench of Justices Chudal and Sharma on May 30 was made public by the Supreme Court on Wednesday.
The order mentions that the audio content has been proven to be fake. Now a full bench will be constituted with at least 7 or more judges to hear this case and the decision will be made from that.
Only after the meeting of the bench management committee of the Supreme Court, the date of payment of the case will be decided. The bench of Justices Chudal and Sharma said about the reason for sending this case of contempt to the full bench, "Fact and truth, freedom of opinion and freedom of expression and freedom of publication should be judicially explained in a concrete and appropriate manner and the long-term aspect should also be directed."
In the Supreme Court's order, it has been said that 'the video clip submitted in the present case was downloaded on a mobile phone, and the said dialogue was fabricated from the scientific test report regarding the disputed dialogue'. It is mentioned in the order that the decision of the important question whether the said action has been an act of defaming and dehumanizing the judges of the Supreme Court, learned legal professionals, the media sector and respectable personalities should be decided by a full bench.
The material circulated on 'Sidha Kura.com' named 'Dark File' defaming Supreme Court judges, lawyers, media entrepreneurs and journalists was confirmed to be 'fake' in laboratory tests. The material has been confirmed as 'fake' in the test conducted at the forensic laboratory of the police. The police examined the material and sent the report to the Supreme Court. The content titled 'Secret Deal to Lose 400 Cases, Supreme Court Judges, Kantipur and Annapurna Creditors Joined' was published/broadcasted on Baisakh 14 through an online and YouTube channel called 'Sidha Kura'. After the broadcast of the audio, on May 16, the Supreme Court administration filed a contempt case against Kandel and Dhungana of 'Sidha Kura' through Sub-Registrar Ghimire, saying that misleading content was being broadcast to obstruct the judicial process.
