Janata Samajwadi Party Nepal insisting that the 7 MPs who split the party are not currently MPs legally and requested the Speaker not to participate in the Prime Minister's vote of confidence.

Party President Upendra Yadav sent a letter to the Speaker of the House of Representatives, Devraj Ghimire, on Sunday, and 7 MPs have left JSP Nepal, but the case related to the registration of a new party is pending in the court.

'.....According to Section 31 (2) of the Political Party Act, the members who were elected from this party and who have left the party have automatically become vacant. , Pradeep Yadav, Hasina Khan and Sushila Shrestha cannot be included in any activities of the House of Representatives, including the process of vote of confidence to be taken by the Prime Minister, until the final order from the court, so there is a sincere request to comply with the Supreme Court's interim order,' Yadav said in a letter to the Speaker.

7 MPs registered their new party 'Janata Samajwadi Party' with the Election Commission on February 23. But in the writ filed in the Supreme Court, the court issued an interim order on June 2 and ordered that the work related to the formation of the new party and organizational expansion should be kept as is immediately. 

Chairman Yadav based on the provision that 'if any member leaves the party contrary to the subsection (1) of section 31 of the Act on Political Parties, the position he was elected to will be considered automatically vacant from the date he leaves the party'. 7 MPs have claimed to be without a party.
