After keeping the reports of various commissions and inquiry committees on the protection of government-public lands that are being encroached and illegally occupied by various parties, the government is again busy collecting data.
The commission and the investigation committee formed by the government, which recommended taking action against the encroached land return and embezzlers across the country including Kathmandu Valley, have resumed the work of collecting details without even making public. The Ministry of Home Affairs has instructed all the 77 district administration offices to collect the tax. This has led to duplication in the search for encroached and looted land, as well as the risk that the person recommended for action will remain outside the legal scope. The report led by former secretary Ram Bahadur Rawal, which was previously studied and submitted as a suggestion to the government, has been stored in the Prime Minister's office for 28 years, and the report of the commission of inquiry led by former judge Mohanaraman Bhattarai has been stored in the Prime Minister's Office for 3 years. The Home Office has issued a circular to the Chief District Officers (CDOs) to collect the revenue from scratch, leaving the recommendations of the reports of both the commissions, which are still kept secret, from being implemented. It is still a secret that the commission led by former secretary Rawal submitted a report to the government in 2052 with a list of land encroachers and recommendations for action, saying that about 1,860 acres of government-public land in the valley had been encroached and embezzled in the name of individuals. Last time, in June 2076, the commission of inquiry formed under the leadership of former judge Bhattarai took about 20 months and submitted a report to the government. The Bhattarai Commission has recommended action against encroachment and embezzlement of more than 500 bighas in various districts of the country, including Kathmandu, and this report is still secret.
During the time of the then Prime Minister KP Sharma Oli, a circular was issued to the district land reform offices on May 2, 2076 and March 19, 2076 to implement the past reports.
The last time when Sher Bahadur Deuba was the Prime Minister, the government decided to implement the Bhattarai Commission report in June 2079. However, the decisions of both the governments have not been implemented. In the House of Representatives meeting on Friday, the parliamentarians expressed their displeasure at the directive to collect data from the Ministry of Home Affairs by hiding the old reports. Independent Member of Parliament Amresh Kumar Singh expressed his displeasure saying that if the report is implemented, the government is trying to protect those who embezzle in the name of re-collecting the tax due to the fear of being prosecuted. In both the past reports, the details of the land that has been usurped and illegally occupied by land mafia, locals, businessmen and organizations in various districts including the valley have been included. If these reports are to be implemented, government-public land worth billions of rupees will be returned and the embezzlers will be prosecuted. However, the government is not interested in that direction.
The Ministry of Home Affairs has informed that a circular has been issued to the district administration offices to take action against land embezzlers. The home has also appealed to give notice to those who are embezzling land. Prazia has the main responsibility to protect government/public lands within the district. However, with the connivance of Malpot, Napi, Guthi and the employees of the district administration themselves, land mafia, various organizations, individuals, middlemen and leaders/activists of political parties are encroaching and illegally occupying land. Only in Kathmandu, government land has been illegally given to various organizations from the offices of political parties and fraternal organizations. The office of the Maoist staff organization is in the government land in the Bhrikutimandap complex. In front of the south gate of Singha Darbar, the building of Emalenikat Civil Servant Organization is in the government land. There is an office of the Teachers' Union near the ruling Congress on government land, while the office of the Democratic Samajwadi Party (LOSP) in Bahramahal is also on government land. In this way, unauthorized occupation and construction of structures on government land has taken place all over the country. However, no effort has been made to control it and bring it under government control.
In June 2075, a committee was formed under the coordination of former secretary Sharada Prasad Trital to investigate the embezzlement of Lalita Niwas in Baluwatar and the embezzlement of government land. Based on the recommendation of the committee, the authority investigated and filed a case in the special court on 22nd January 2076. Just last week, the court convicted 131 people including 2 former secretaries, land mafia, fake Mohi, then occupiers and ordered to maintain more than 136 ropani of looted land in the name of Nepal government. was given This special verdict has given the government an opportunity to conduct a thorough investigation and take action against embezzlers of government land across the country. However, since the reports of the past commissions and committees are not made public, action has not been taken against those who have committed illegal activities and transferred government land in the name of individuals.
Former Judge Bhattarai, Chairman of the Commission of Inquiry on Government, Public and Guthi Land Protection, said that although the report was submitted to bring the encroached land under the name of the government, take action against the culprits and protect government/public land in the future, it has not been implemented. "We have spent about 20 months and submitted a report with suggestions/recommendations to the government containing the details of the encroached land in the main places," he said. The commission has searched only the main places, if you search the whole country in an improper manner, more will be found.
In the petition filed by advocate Prakashmani Acharya on behalf of the Public Interest Protection Forum in the year 2060, the government is a silent spectator even when there is encroachment and embezzlement of government/public land. The Supreme Court also gave a directive order to the government on land conservation. 7 years after the filing of the writ, on May 12, 2067, the bench of Judges Tap Bahadur Magar and Mohan Prakash Sitaula also ordered for the proper protection of public and government land as per the survey of 2021. However, according to the judgment, the government has not been able to take effective initiatives to protect encroached land. The decision to implement the report of the Bhattarai Commission was made by the Council of Ministers in 2076 and 2079, but the work has not been done yet.
