Kartik 22
Chief Minister Jitendra Prasad Sonar (Sonal) had reached the Madhesh Province Assembly to seek a vote of confidence. Before that, the meeting of the Business Management Advisory Committee had agreed to keep only the agenda for taking a vote of confidence. All the parties had already decided to vote for the Sonal-led government in a meeting. The CPN-UML and the Nepali Congress had decided not to vote in the party meeting. The MPs of the Raprapa and Nepal Federal Socialist Party were absent from the meeting that day. The remaining 6 parties had decided to vote for the Sonal-led government in a party meeting. The Janata Samajwadi Party (JSP) Nepal, Janmat Party, CPN Maoist Center, Loktantrik Samajwadi Party (LOSP), CPN Unified Socialist and Nagarik Unmukti had decided to vote for Sonal in a party meeting. None of the MPs from the parties who voted in the party meeting expressed objection or disagreement. The meeting, which was called at 1 pm that day, started about an hour and a half late.
After the meeting began, Sonal proposed a vote of confidence in the Madhesh Province Assembly. He sought votes from all parties and MPs. He urged everyone to vote together to protect federalism and send a positive message towards federalism. According to the same decision, the leaders of those parties had announced that they would vote for Sonal from the rostrum, while the MPs of the Congress and UML had said that they would not vote. After the party leaders had spoken, CPN Maoist Center MP Rahbar Ansari stood up and signaled to speak. Speaker Ramchandra Mandal allowed him to speak from his seat. However, after MP Ansari requested to speak from the podium, Speaker Mandal allowed him to speak within three minutes. This item was not on the agenda.
MP Ansari announced that he would not vote for any government, saying that the floor of MPs and leaders had been filled. And, he opposed the leaders by covering his own face with a mask. Immediately after that, Maoist MP Mala Karna agreed with Ansari. Then Chief Minister Sonal came to answer the questions raised against the government. He again urged all MPs to vote according to the party's decision and requested not to adjourn the meeting for some time.
CPN-Maoist Center leader Bharat Prasad Sah also objected to the fact that he was allowed to speak outside the agenda and demanded that the meeting be adjourned for 30 minutes. However, the Speaker seemed to be determined to continue the meeting. Then, the government MPs boycotted the meeting and walked out. After the government party left, Speaker Mandal adjourned the meeting for ten minutes. Efforts were being made to persuade Ansari and Karna, who were angry after the meeting was adjourned. Both of them were also receiving calls from top leaders. Karna finally agreed to vote, but Ansari did not. Some MPs were requesting Speaker Mandal to adjourn the meeting. However, the Speaker said that this could not be done.
The meeting, which was adjourned for 10 minutes, resumed after about an hour. However, the ruling party MPs had not reached the meeting room at that time. After the Speaker rang the bell and instructed to close the door, LSP MPs came and requested that the meeting not be held as they were not in the government party. However, the Speaker requested them to come within three minutes, saying that the vote should be divided.
Immediately after the adjournment, Chief Minister Sonal resigned, saying that there was no environment for a vote of confidence and that the Speaker was responsible for the entire situation. Outside the provincial assembly, leaders and activists of six parties had also raised slogans against Speaker Mandal. After coming from the Madhesh provincial assembly, Sonal submitted a written resignation to the provincial chief. Her resignation was immediately accepted by provincial chief Sumitra Bhandari. . Kartik 23 The provincial chief had been engaged in separate discussions with all the parties since morning. The Congress was neutral till afternoon that day. UML was adamant that Article 168 (2) of the constitution had been repealed and that it was in a position to form a government according to another article. On the other hand, the six parties were saying that the article was still alive and that a call should be made for the formation of a new government accordingly. Throughout the day, there was a crowd inside the Madhesh Bhavan at the Chief Minister's residence and the provincial chief's office located nearby.
The leaders of the six parties were trying to drag the Congress. Around 3 pm, the Congress agreed to go with 6 parties. After that, the leaders of seven parties, including the Nepali Congress, met the provincial chief and requested him to invoke Article 168, Clause 2 of the Constitution, as it was still alive, and call for the formation of a new government.
The provincial chief had promised to go according to the constitution. However, at 8 pm, these seven parties received news that, ‘The provincial chief, as the largest party in parliament, appointed UML leader Saroj Kumar Yadav as the Chief Minister and administered the oath and started heading towards Kathmandu.’
Then, the leaders of all seven parties went to meet the provincial chief again. And, the leaders and workers of these parties kept vigil around the provincial chief’s office. At 10 pm, all seven parties issued a statement requesting the provincial chief in writing. The statement stated that a call should be made for the formation of a new government according to Article 168, Clause 2. At 3 pm, Province Chief Bhandari called Chief Minister Sonal to meet her. And, she said that she was going to Kathmandu because she was sick. The Province Chief had told Sonal that she was suffering from asthma. However, the Province Chief appointed CPN-UML leader Saroj Kumar Yadav at the Panas Hotel in Bardibas and administered the oath of office to him. Along with Yadav, Lakhan Das Tatma of his party and Bimala Ansari of Nepal Federal Socialist Party took the oath of office as ministers. On October 24, the leaders of the seven parties were gathering at the Chief Minister's residence in Madhesh Bhavan. They were meeting and discussing the future strategy. At 9 am, the leaders of all the seven parties sat for a discussion. During the discussion, the news came that the newly appointed Chief Minister Saroj Kumar Yadav was coming to Madhesh Bhavan to take charge. After leaving the discussion, the leaders and supporters reached both the gates. Outside the gate of Madhesh Bhavan, leaders and activists supported by seven parties were demonstrating by burning tires. The crowd that reached the office of the Chief Minister and Council of Ministers in the covered hall of Madhesh Bhavan vandalized and forced the employees to leave. At that time, there were only three employees in the office. One was looking for a lock, while the other was looking after some belongings to protect the record file. LOSPA leader and former MP Parameshwara Sah started beating the same employee. Other people also beat the employee along with him. Congress Provincial Assembly member Birendra Singh was vandalizing. He had destroyed some belongings including the national flag. LOSPA MP Upendra Mahato was stopping them from vandalizing. Mahato had also immediately picked up the flag dropped by MP Singh. Later, after the video went viral on social media, MP Singh released a video with an apology and a video of him respectfully placing the flag.
Then a demonstration took place in front of the provincial chief's office. The provincial chief's 'name plate' was broken and slogans were raised. MPs were also present in the demonstration. JSP MP Lalita Das smashed the flower pots and urns placed in front of the provincial chief's office at the door. Other protesters were shouting slogans against the provincial chief. Inside the office, the Nepali Army remained a mute spectator.
The leaders of the seven parties were calling MPs to sign the Nepali paper at Madhesh Bhavan. Before that, the leaders had already decided to take legal action against the appointment of the Chief Minister. After that, the crowd calmed down. And, they were discussing the newly appointed Chief Minister Yadav not being allowed to enter Madhesh Bhavan and other news. In the afternoon, Rakki Prasad Sah filed a writ petition in the Supreme Court, making the Office of the Provincial Chief and the Office of the Chief Minister and Council of Ministers respondents.
Kartik 25 On Tuesday, Madhesh Province Chief Minister Saroj Kumar Yadav reached Madhesh Bhavan for a 'morning walk'. The Chief Minister, who reached the Madhesh Bhavan in a group of a dozen people, expressed dissatisfaction with the security personnel at Gate No. 2 of the Madhesh Bhavan. On Monday, he said that the police had failed to protect public property inside the Madhesh Bhavan and directed them to tighten security arrangements. 'You are the servants of the nation, the representatives of the nation, if you do not protect the nation, who will?', he asked the security personnel, 'When there is an attack on national integrity, the national flag, and the national sovereign power, who will stand for justice, then the country's police will stand. But, we could not even take control of the person who threw the national flag yesterday. Can't the police stop a group of 15/20 people? There are thousands of police here again. Will they allow it to be destroyed forever? Let there be strong initiatives to protect the property.' After that, Chief Minister Yadav inspected the ministries and the offices of the provincial chief inside the Madhesh Bhavan. As soon as the Chief Minister finished the inspection, the leaders of the seven parties had also received the news. Their leaders and MPs were also eager to attend. Representatives of the seven parties had already left to file a writ in the Supreme Court. When the leaders of the seven parties reached the Madhesh Bhavan, they received news that entry was prohibited. Security personnel stopped everyone except the provincial assembly members at the gate. After that, the MPs of the seven parties started preparing to prevent the Chief Minister from taking office inside the Madhesh Bhavan. And, they blocked the east-west road next to the Madhesh Bhavan. MPs of all the seven parties sat on a sit-in in front of gate number two, blocking the road. Later, they sat on benches and the coming and going of MPs, leaders/activists continued. Behind the sit-in, a demonstration was being held by burning tires. The protesters were shouting slogans against Chief Minister Yadav. At that time, Chief Minister Yadav had organized a press conference at Janaki Star Hotel in Janakpurdham Sub-metropolitan City-8. In the press conference, he said that the appointment was made as per the constitution and that he had put pressure on the provincial chief to take oath. Apart from this, Chief Minister Yadav was meeting and giving interviews to journalists throughout the day. He was also taking news from inside Madhesh Bhavan. He was telling the employees to make arrangements for the assumption of office. The demonstration of the seven parties was thinning out.
Then in the evening, the crowd was again increasing in the demonstration in front of Madhesh Bhavan. After the Supreme Court order, the supporters of the seven parties were celebrating. The enthusiasm of the workers reached its peak when Sonal, JSP Chief Whip Ram Ashish Yadav and other MPs came out from inside the Madhesh Bhavan. Sonal and other MPs were requesting the crowd to stop shouting and shouting slogans. After about five minutes, when the protesters calmed down, Sonal grabbed the microphone and enthusiastically announced the news, thanking everyone including the court. Representatives of seven parties including Sonal were protesting by blocking the east-west road next to the Madhesh Bhavan, while Chief Minister Yadav entered from the armed barracks road on the south side and took charge. While taking charge, Chief Minister Yadav had decided to honor the martyr's family with cash and the Madhesh Vibhushan. The protesters, who were celebrating since then, started shouting slogans loudly after hearing the news of his taking charge. The police had lathi-charged the crowd to control and disperse it. The crowd, angered by the police's lathicharge, was throwing stones at the police station. About a dozen protesters were injured in the lathicharge by the police.
