When he was arrested on October 26, 2076, on the order of the Supreme Court, on the charge of burning the victims alive in a chimney furnace, Alam threatened DSP Karki with his old arrogance.
The Rajpur bomb attack suppressed under the guise of political power was investigated by the then District Police Chief SP (currently SSP) Bhupendra Bahadur Khatri, DSP Karki and Police Inspector Pappu Nayak.
12 years after a bomb exploded in the shed of Congress leader late Sheikh Idris in Rajpur on 27th Chait 2064, with the arrest of Alam on 26 Oct 2076, the investigation of the incident, which was anonymous under political cover, got meaningful . DSP Karki was assigned to arrest him. It was a big challenge for the police to arrest Alam. Alam Shakti was in the guise of power since the beginning of this incident which was buried under political cover. So he was sure that nothing would happen to him.
After being arrested, Alam warned DSP Karki that he would be handcuffed inside the car he was riding in. While threatening, DSP Karki was reminding Alam by saying 'peace security is also your responsibility'. Alam, who had access and power to the central circle of that brutal incident, which is remembered as a
, was arrested on the afternoon of October 26, 2076, when he was leaving Farhadwa village for a relative's wedding in the plan of the then SP Khatri, 12 years after the incident. That too from Sheikh Idris Gate, which was built in the memory of his deceased uncle at the exit from Rajpur to Mulbato.
In the incident, 22-year-old Trilokpratap Singh and 20-year-old OC Akhtar of Saruatha, located in Yamunamai Rural Municipality-4, were thrown alive into the chimney furnace. Singh's father Srinarayan and OC's mother Ruksana Khatun reached the district police office with a complaint on 2065 Baisakh 6, 8 days after the incident. . But there was no hearing. The district police team reached the spot and said that there was no bomb explosion.
The then SP of District Police Rautahat, Lakshman Neupane, who was killed in the Tikapur incident, informed the then Chief District Officer Durga Prasad Bhandari that there had been a bomb blast in Rajpur but there was no damage.
Bhandari has mentioned in the statement that he instructed SP Neupane to investigate. According to Bhandari's statement, it seems that SP Neupane is trying to reconcile the incident. Under his instructions, the bond was raised immediately. For this reason, the then SP Neupane of the district police did not register the complaint of Singh and Khatun. After ignoring the complaint of both, it was sent by post on May 9.
On 18th Baisakh, the police called both the victims and identified them. After registering the complaint, 5 people along with Aftab Alam appeared at the district police office on 9 June 2065. On the instructions of SP Neupane, the police took a statement from them on the same day. On the same day, the police submitted the case to the district attorney's office along with the proposed indictment. Normally, in such cases, the police, who investigate by detaining common people for 25 days, under the guise of power, released the case on the same day after completing the statement. On the same day, District Attorney Dhruvamani Gyawali decided not to prosecute everyone including Alam.
The decision made by the district attorney reached the office of the attorney general via Hetaunda and the appeal court confirmed the decision not to pursue the case . The Attorney General's office confirmed the decision made by the district on June 30, 2065 not to prosecute anyone in the case of duty-bound death. In the last point of the decision, it is said, "If the case can be prosecuted later, the opinion of not prosecuting anyone at this time is valid." After the Attorney General's office decided to close the case file within three months, the judicial journey of the bomb case was incomplete.
Alam is in a legal trap after 12 years of the incident with the sentence that the case may be started at some point. Till that time, under the guise of power, Alam did not let the case reach the court. Srinarayan and Ruksana filed a petition in the Supreme Court demanding the annulment of the decision made by the attorney on July 25, 2065. On May 16, 2079, the then Chief Justice Sushila Karki and Bharat Bahadur Karki gave a directive order in the name of the government saying that the case should be seriously investigated and prosecuted in the writ against the decision of the Attorney General. Then the victims went to the Judgment Implementation Directorate. There was no hearing .
OC's mother Ruksana Khatun was shot and killed in mid-January 2079 while she was running for justice in the middle of the case. While she was returning to her home in Saruatha from Chatauna in Durga Bhagwati Rural Municipality, some people who were hiding in the sugarcane field shot and killed Ruksana .
Then Sreenarayan felt a security threat . He was scared . He was also afraid of being killed and on May 18, 2072, he asked Pushparaj Poudel, an advocate of Kathmandu, to file a contempt case. On June 6, 2076, the Supreme Court wrote a letter to the Attorney General's Office asking why the order was not followed. Every year, the Supreme Court's Judgment Implementation Directorate sent directive letters to the District Attorney's Office asking them to proceed with the investigation into the incident. Since June 16, 2069, the Supreme Court's Judgment Implementation Directorate has sent a letter to the Public Prosecutor's Office 5 times asking it to implement the order . It seems that the public prosecutor's office has given correspondence to the district police office, giving formal processing to all such letters.
It is seen that the district police is also appointing an investigation officer for the purpose of completing the paper process only, but does not take the investigation forward . The then SP Khatri said that nothing happened during the 12-year period except weeding. 15 chiefs changed after this incident in the district police.
After being promoted from DSP to SP, SP Khatri, who came to take over the leadership of Rautahat Police on February 2, 2075, started the investigation of unsolved old files. He started investigating the incident involving Alam at the beginning. The course of investigation of the Rajpur incident changed only after the arrival of SP Khatri. The then SP Maheshvikram Shah, who was transferred on October 25, 2069, tried to carry forward the investigation of the Rajpur incident. But he was also transferred after four months. SP Yagyavinod Pokharel, who was transferred to Rautahat on November 16, 2073, claimed that he had not received any letter from the Supreme Court. Pokharel is now the Chief DIG of Madhesh Police Office, Janakpur.
This incident, which had been under the influence of the power center for years, was not investigated. On May 14, 2076, the district attorney's office instructed Rautahat of Zipra to investigate the incident. The Supreme Court was communicating every year where the investigation had reached and what was going on. But the district police chiefs did not dare to proceed with Alam's case . SP (currently SSP) Khatri told that the investigation conducted after the incident was very weak. He said that he managed to bring the investigation to a logical conclusion by contacting the injured including those working in the chimney kiln during the incident. We had to face various challenges. We worked day and night to gather evidence,' he said.
Police arrested 11 people including Congress leader Alam, his brother Mohammad Mahtab Alam, Sheikh Seraj, Sheikh Fazlehaq, Sheikh Bhadai, Sagir Alam, Badri Sahni, Gaurishankar Shah, Mukti Shah, Mohd Mobin Alam and Sheikh Jumeen Sheikh Malkar. It was a challenge. Soon after the Supreme Court's letter came, a team including the then SP Khatri sat and made a plan. First of all, the police assessed that the arrest of former minister Alam in the village might lead to a clash, and Khatri made a plan to capture him alone. According to the same plan, on 26 October 2076, he was arrested by DSP Karki at Sheikh Idris Gate, going to Rajpur village. At that time, Alam became aggressive and threatened DSP Karki. Soon after Alam's arrest, the investigation started . First of all, the police had to contact the eyewitnesses of the incident and the injured. Most of the people working in chimney kilns were from Bara.
The police started looking for them . Sarlahi was also injured in the explosion. "We went to the village of Bara and Sarlahi and took statements from the eyewitnesses of the incident," he said. They were afraid that Alam would kill them.
It was not possible to bring the eyewitnesses and the injured to the police office immediately and they refused to come because of the fear of Alam, so the police went to the house and secretly took their statements. Gaurishankar Ramchamar, 42 years old, from Musachok, Bairagania, Sitamarhi, Bihar district, India, who was injured in the blast, was brought to the office by the police and given a statement. Among the injured, he is the most injured.
But while the people of Alam side were taking Chamar to the court to change his statement in kidnapping style saying that he had faked injuries, DSP Karki's team found him on the way and took him to a safe office. After that for some time, Chamar stayed in the security circle of the police . Samsul Mia is the father-in-law of the OC who was killed in the incident . After the death of his son-in-law, he is living in a house in Saruatha, taking care of the family with his daughter and two grandsons who became destitute . He was living in Lalbandi of Sarlahi and was doing business of sending vegetables to Kathmandu. He came home only on the day of the incident. The son-in-law, who came home from Dubai on vacation only a few months ago, went to Alam's election campaign without hearing anything from anyone.
After Alam's arrest, Samsul said that he saw the scene where the police car also arrived at the scene and on the contrary, the police were helping to solve the incident. But the same Samsul has recently changed his statement . He said that his son-in-law is alive and abroad. He did not want to say anything about the incident. "I don't know anything about the incident." Don't ask me anything,' he said, 'Now I am not going to say anything.' Samsul, the father-in-law of the OC, who was crying after the
incident, changed his statement. A local said that the main eyewitness of the incident was an Indian worker working in the same kiln and after the incident, everyone returned to India out of fear. No one has any evidence that can tell exactly how many were injured in the incident, how many were killed immediately and how many were killed later by the people of Alam . Rautahat of Zipra took a statement from 59-year-old Safi Ahmed of Sarlahi, who was injured in the same explosion and escaped with his life. He said that his stomach was seriously injured during the explosion and his intestines came out. There is a big bruise on his stomach.
On the night of the explosion, the then SP Neupane, the then Chief District Officer Bhandari and the then SP Ramakrishna Lama of the armed forces reached the shed at Farhadwa, the victim claims. Also, on the day after the incident, SP Neupane informed the media that no one was injured and no one died. He reported the same to Prazia Bhandari immediately after the incident. After the interest of human rights workers, opposition parties and media workers increased about the incident, SP Neupane took charge of the incident site.
According to the police, in the old file of the incident in Zipraka, neither the picture of the incident site nor the complete details of other incidents are found. There is no mention of bomb explosion in the report of the incident. In the days after the incident, the role of the police is not only questionable, it has been seen that the paper process in name only has been carried forward to fulfill the interests of Alam who are in the power center . As the demand to investigate the incident increased, SP Laxman removed the clay from the brick kiln on 16th Baisakh and on 17th Baisakh and sent it to the forensic science laboratory of the police for testing. In order to strengthen Alam's selfishness, the then SP Neupane sent the clay and bricks of the kiln different from the brick kiln where the body was burned for testing.
The Khatri-led police took statements from more than 30 people, including eyewitnesses and injured persons. The then Inspector General of Police Om Vikram Rana, the then Chief of Central Police Office Hetaunda DIG Kiran Gautam (currently retired from AIG), the then SP of Rautahat Armed Police Ramakrishna Lama have stated that they are aware of the incident. SP Khatri told that there is a basis to confirm that the bomb exploded.
The district police accused Alam, his brother Mohammad Mahtab Alam, Sheikh Seraj, Sheikh Fazlehak, Sheikh Bhadai, Sagir Alam, Badri Sahni, Gauri Shankar Shah, Mukti Shah of killing Srinarayan's son Trilok and Ruksana Khatun's son OC by throwing them alive in the chimney furnace. , Mohd Mobin Alam and Sheikh Malkar named as Sheikh Jumeen filed an indictment before the court on October 18, 2076 with the demand of life imprisonment for the crime of duty killing, killing industry and explosives. Alam has given a denial statement before the court saying that there was no bomb blast and that it was a political vendetta against him. The court asked Alam 52 questions related to the incident. He has refused to answer all the questions.
District Court Gaur ordered Alam to be remanded in custody on November 29, 2076. After almost 4 and a half years, the bench of District Court Gaur Judge Matrika Prasad Acharya sentenced four people including Alam to life imprisonment on Thursday 13th. Alam is now in Nakhkhu Jail. Brother Mehtab Gaur is in jail. Saying that they got justice because of SSP Khatri, Sreenarayan thanked Khatri by telephone on 13th Baisakh, the same day four people including Alam were sentenced to life imprisonment.
