The Association of Nepalese Origin (ANO) has submitted suggestions, including that the draft of the Non-Resident Nepali Act, 2082, contains errors in the definition of non-resident Nepalis and that the tax system is impractical. ANO has submitted suggestions to the Ministry of Foreign Affairs for amendments to the draft.
ANO has also suggested amendments to the draft of the Non-Resident Nepali Act of the Government of Nepal to improve the property and tax provisions of non-resident Nepalis, provisions related to non-resident Nepali associations and charitable funds, recognition of Nepali-speaking identity, and addressing communities of Nepali origin in third countries.
The suggestion letter signed by ANO President Dilli Adhikari, who is active in 9 countries around the world by establishing branches, states that the extensive revisions to the definition of ‘person of Nepali origin’ in the Act (Section 2, Clause e) have not only affected the identity of non-resident Nepalis but have also deprived the later generation of Nepalis born abroad.
‘No matter where one is born in the world, one’s ancestry is linked to ‘Nepali origin’ (Nepali origin) through historical, cultural and blood ties, and if one has already obtained citizenship or identity card of a third country, such a person should have the full right to obtain an ‘Identity Card of Nepali Origin’. The Government of Nepal should give priority to the relationship of ‘Nepali origin’ over ‘place of birth,’ ANO’s suggestion letter states.
ANO has also suggested reforms in property and tax provisions (Sections 10 and 23). It has stated that the provision in the draft requiring 50 percent revenue to be paid when transferring property is impractical and discouraging. To correct this provision, ANO has also demanded that the draft act should include a provision that persons of Nepali origin should pay only the same tax or a reasonable minimum fee as Nepali citizens when transferring property acquired by sharing, purchasing or investing in their ancestral property.
Stating that people of Nepali origin should be accepted as an 'integral part' of Nepal, rather than 'foreigners', ANO President Adhikari expressed confidence that the Act will help Nepal mobilize the knowledge, skills and capital of people of Nepali origin from around the world.
