The family of Nepal Investment Mega Bank Limited (NIMBL) Chief Executive Officer (CEO) Jyoti Prakash Pandey has filed a habeas corpus petition in the Supreme Court, claiming that he has been illegally detained. 

On behalf of Pandey, his wife Niru Dahal filed the habeas corpus petition  on Wednesday. The petition has been scheduled for hearing before the bench of Justice Abdul Aziz Musalman. 

Pandey was arrested at around 8 pm on Tuesday during a vehicle check in the Bus Park area of ​​Kamalamai Municipality-6, Sindhuli. 

Smart Telecom Pvt. Ltd., which came into operation after obtaining a basic telephone service license from the Nepal Telecommunications Authority on 2070 Baisakh 2, had its license automatically cancelled from 2080 Baisakh 3, as per Section 25(5) of the Telecommunications Act, 2053 BS.   

The CEOs of the National Bank, the Bankers Association and various banks have drawn the attention of the Central Investigation Bureau (CIB) to the violation of jurisdiction in the arrest of CEO Pandey. 

They have drawn the attention of the CIB to the jurisdiction stating that the CEO of the bank is within the regulations of the National Bank and that only the Banking and Financial Institutions Act, 2073 and the Secured Transactions Act, 2063 are applicable to the loan auction.

Subsequently, as per the Telecommunication Service Providers' Asset Management Regulations, 2079, the police have stated that they are investigating Pandey, who is also the chairman of the Loan Recovery Committee (LRC), on charges of irregularities in the auction process with the aim of dishonestly terminating the rights of the Government of Nepal.

According to the police, in the auction notice published by Nepal Investment Mega Bank on 3 Asoj 2082, Smartcell had mentioned that the house rent and electricity bill due to the landlord should be included in the bid amount and about 400 million rupees. The family has demanded his immediate release, saying that the arrest was unlawful as it violated their jurisdiction.
