The inquiry committee has submitted the report to the Prime Minister's Office with the conclusion that the documents submitted by the suspended chairman of Insurance Authority Sharad Ojha when he was appointed are 'suspicious'. A three-member committee chaired by former judge Krishna Giri submitted its report last week. Kapil Wali and Jeevan Prakash Sitaula are members of the committee.
Sources said that the report has been sent to the Ministry of Finance for implementation. "The report has pointed out that the minimum experience of the relevant sector has not been completed and the performance is weak as stipulated by the law," the source said, "The report has been sent to the Ministry of Finance for implementation." According to sources, the documents submitted by Chairman Ojha during the investigation based on the assigned workload of the
committee did not reach the field of experience prescribed by the law. The committee looked at the experience of Chairman Ojha as a priority. Based on the submitted documents, we have seen in which field he has worked. He has worked as a senior correspondent in the media sector.
It was confirmed that he only worked with the media sector, but the law stipulates that the president of the insurance authority must have five years of high managerial experience in the relevant field. Experience working in the field of communication did not represent the relevant field. Ojha was found to be working as a senior correspondent instead of the top management of the organization. We have submitted the report by including the same details as found in the study.' Sources said that since the document submitted by Ojha is not genuine or fake in the mandate, the committee has not looked into it. "If someone raises a question about whether the document is genuine or fake and a case is registered, it is the job of the court to look into it," the source said, "The committee found that there is no high managerial experience in the field related to extortion as per the provisions of the law."
The government formed a committee on June 30 to investigate the documents, qualifications and working methods submitted by President Ojha when he was appointed. With the formation of the committee, Ojha has been suspended. According to the provisions of Section 12 of the Insurance Act, the government constituted an inquiry committee.
"The government of Nepal should remove the chairman or member from office, he can remove him from office on the recommendation of a three-member investigation committee consisting of a retired high court judge and two people with at least 10 years of experience in the insurance or financial sector," section 12 of the Act states, "After the investigation committee is formed, such person will be automatically suspended until the end of the investigation period."
Ojha was appointed as the chairman of the authority for 4 years from the cabinet meeting on 12 February 2081. The Abuse of Authority Investigation Commission started the investigation from last May after the documents regarding Ojha's qualifications and experience were found to be questionable. The Authority has withdrawn the documents from the Ministry of Finance saying that the appointment was made on the basis of the documents submitted by Ojha without double examination.
A petition was also filed in the Supreme Court on March 17 against the Prime Minister and Cabinet Office, the Ministry of Finance, the Recommendation Committee and Ojha, claiming that Ojha's appointment was illegal. Three days after that, on 20 Chait, the bench of Judge Nahkul Subedi issued a show cause order in the name of the government and called both parties for discussion.
Last time on 5th June 2082, the bench of Chief Justice Prakashmansingh Raut and Justice Nityanand Pandey ordered Ojha to submit documents related to the basis for his appointment as President. The case is still pending.
A complaint was also filed against Ojha's appointment in the authority. After seeing the quality of the documents submitted by Ojha in the initial investigation, the authority started a detailed investigation. About the validity of the documents submitted by Ojha stating that he has worked in various offices and companies, the Authority has already sent a letter to the concerned office-company asking them not to disclose this. Officials of the Authority have said that details are being received from the relevant office-company regarding the letter being sent and a detailed investigation is underway.
Ojha has also submitted experience of working as a local agent of a foreign company that purchases strategic and security materials, Senior Manager at Trinity Exim Pvt. Ltd. from 18 October 2019 to 16 November 2021, 'Part-time' consultant at the Investment Board under the Government of Nepal from 15 January 2024 to 23 May 2024, Confederation of Nepal Industry (CNI) from 11 May 2024 as a policy expert at Federation of Nepal Industry and Commerce.
It seems that Ojha has submitted a document with the experience of teaching in the resource faculty of Nepal Academy of Tourism and Hotel Management (Natham College) from January 2017 to the time of his appointment (2025) and in SAIM College from December 2022 to 2024.
Ojha has also submitted documents of experience as senior manager in Chanakya Media Pvt Ltd from 16 December 2021 to 22 January 2025. Similarly, from 27 Baisakh 2080 till the time of his appointment, he was a press representative from the Information and Broadcasting Department and also worked in Deshsanchar media from 17 November 2017 to 16 August 2018.
Ojha has also submitted a certificate that he worked as a manager from January 1, 2073 to October 2074 and as a management officer from November 1, 2070 to October 2072 in the administrative media. Ojha has also submitted his teaching experience in Rajdhani College from 2018 to 27 December 2024, in Apex College from January 2017 to 23 September 2024 and in Imperial College from April 2018 to September 2024 under the eligibility documents for the Authority Chairman.
It is mentioned in the complaint filed with the authority that the documents submitted by Ojha were not double-checked, his experience was not related to insurance and the verification of those documents was also done by a one-member committee.
In Section 8 of the Insurance Act, 2079, the basis of qualifications for the president or member of the insurance authority has been determined, including at least 5 years of high managerial work experience in the relevant field with at least a master's degree in insurance, monetary, banking, finance, commerce, management, public administration, statistics, mathematics or law. But a complaint has been filed in the authority and a writ has been filed in the court with the claim that Ojha was appointed as the president against the law.
