Six years after the promulgation of the Act, the government has established a consumer court with three districts of Kathmandu Valley as its jurisdiction. The meeting held on Monday by the Council of Ministers decided to form a consumer court.
The court will decide the cases related to black market and inflation. The court also has the right to compensate the consumer according to the law. This court will hear the case if the seller deceives the consumer and sells low quality goods, if the price is arbitrarily high and if there is an adverse effect on the health due to the consumption of any goods.
The arrangement for paying compensation from such sellers is in the Consumer Protection Act 2075. According to the law, a complaint must be filed within 6 months from the date of loss. The Consumer Protection Act was issued on October 2, 2075, along with the legal provision for establishing a consumer court. After 6 years and 3 months of that, consumer court was formed.
Government spokesperson Prithvisubba Gurung informed that the Consumer Court has been established by implementing the provisions of the Act and the orders given by the Supreme Court.
On the recommendation of the Council of Justice, the Cabinet meeting appointed Judge Ram Prasad Sharma of the Kathmandu District Court as the President of the Consumer Court. Justice Sharma has been appointed as the Chairman in consultation with the Judicial Council. The Judicial Service Commission has appointed Deputy Secretary Gehendraraj Regmi and the Ministry of Industry Deputy Secretary Anandraj Pokharel as members of the court.
Law, Justice and Parliamentary Affairs Minister Ajay Kumar Chaurasia said that a consumer court has been formed to hear the complaints of consumers in three districts of Kathmandu Valley. There was talk about the problem in consumables. Keeping this in mind, the consumer court has been constituted to implement the law and the court's order, he said, adding that the court will look into the complaints received from the consumers of Kathmandu Valley.
The Supreme Court ordered the formation of consumer courts in all seven provinces in 2078. However, the government has established a court by assigning jurisdiction to three districts of Kathmandu Valley. Section 41 of the Consumer Protection Act provides for consumer courts. In which the arrangement is mentioned that under the chairmanship of the district judge of the district designated by the government, the deputy secretary of justice service and the deputy secretary appointed by the government will be members.
It has been arranged that a bench with at least one member present in the court can take any action other than detention of the case and a bench with two members can take any other action including detention. In the constitution, there is a provision of fundamental rights that a person who has been damaged by substandard goods or services will have the right to compensation according to law. Citizens were not able to enjoy the said fundamental right if the consumer court was not established.
