The government has made a special arrangement for the return of sunk savings of citizens through an ordinance. In the ordinance issued by the government on Tuesday, special arrangements have been made for the regulation of cooperative organizations and the return of sunk money of savers.
Provisions made in the Ordinance are as follows: Regardless of what is written elsewhere in the prevailing law in the
- Ordinance, savings of up to five lakh rupees accumulated by members of cooperative organizations or cooperative organizations that have been declared problematic according to Section 104 shall be paid on first priority.
- In case of savings of more than five lakh rupees accumulated by the member, the concerned organization will pay the member's savings proportionally according to the criteria, if there is no situation to pay at once.
- For the purpose of returning the savings amount, the cooperative organization or the management committee according to section 105 of the Cooperative Act may sell the mortgage security taken while providing the property or loan of such organization.
- Before selling the mortgage security taken by the cooperative when providing the loan, the related borrowers are given time to repay the loan of the cooperative organization.
- If the sale of such mortgage security results in more money than the amount owed by the debtor, the remaining amount must be paid back to the debtor.
- The cooperative organization shall collect the amount received for providing the house, land or other masonry tools or equipment on lease or rent and use such amount only for the purpose of returning the saving amount of the saving member.
- It appears that due to the filing of a case or any other reason, the property or mortgage protection of the cooperative organization has been suspended in the court or any other body, it is seen that it has not been possible to return the saving amount of the saver member by selling such property and the saving amount of the saving member will be returned by selling such property or mortgage protection. If it is confirmed, the management committee according to Section 105 of the Cooperative Act may request the release of the withholding before the relevant court or agency.
- If a request is made in this way, the related court or agency should release the retention of such property or mortgage security if there is no other reason to hold it.
- For the purpose of returning the saving amount of the savers who are at risk, the authority should make a standard and time-bound return action plan and return the saving amount of the saver member .
- All expenses incurred in managing the property of a troubled organization or association will be borne by the property of such organization or association.
- After the publication of the notification for the return of savings amount, the members, savers, creditors and investors of the troubled cooperatives, banks and financial institutions will have to submit their claim for the amount to be received.
- At least 15 percent of the members of the organization have taken over the assets of the organization, saying that a cooperative organization has not been able to return the deposit to its members, the board of directors has acted against the interests of the members, or the majority of the directors of the board of directors have not attended the general meeting because the members' savings have not been returned. For the purpose of refunding member's savings An application for permission should be made to the relevant cooperative monitoring body to form a committee to return the savings amount and operate the organization.
- The committee formed in this way has to hold a general meeting within 6 months .
- Committee for the purpose of returning the saving amount to the saver member, the amount recovered from the debtor, the amount of income received from the movable and immovable property of the organization and the details of the saving amount returned to the saver should be prepared separately and kept in a safe record . The details of the
- cooperative should be submitted to the relevant cooperative monitoring body every three months.
- Committee shall open a separate account in any 'A' category bank licensed in accordance with the prevailing law related to banks and financial institutions to collect the amount recovered from the debtor, the income received from the institution's movable and immovable property and the amount received from the sale of the institution's property and the saving amount of the member of the saver from that account. Payment has to be made .
