How do you view the report made public by the National Human Rights Commission after the investigation into the human rights violations committed during the Gen-G movement on 23 and 24 Bhadra last year? Questions were raised against the Commission for not making the report public even after completing the investigation. The fact that the Commission's report is made public is good in itself. I have not been able to see all the reports. However, from what I have seen, there are still shortcomings in the effective manner in which the Commission's report should be presented. Some who have evaded responsibility are not being brought to justice. The nature of the action recommended is meaningful. If it is a recommendation that simply grants immunity, it will not help prevent impunity. If it is a recommendation that forces action, it will be achieved. That may reduce the number of arbitrary orders or acts that violate human rights. However, if the recommendation itself is not effective, it cannot be said that the trend of such incidents will not be repeated.
What is the importance of the commission's report?
The commission is a constitutional institution. The issues it speaks about and recommends are important. It is also important internationally. The international community takes the commission's report on notice. They can document it. They make it a reference.
How should the government take the recommendations made by the commission?
It is the government's responsibility and liability to implement the report given by the commission. The Supreme Court's verdict has also ordered the implementation of the commission's recommendations without saying 'if but'. Implementing the recommendations is a mandatory provision. It is unfortunate that the recommendations are not implemented. The government did not implement many of the recommendations made by the commission during the conflict or at other times. That is wrong. How the government takes it and how it moves forward is important. The Commission should be able to stand strong and effective in implementing its recommendations.
What if the government ignores the Commission's recommendations?
The Commission can hold officials responsible for not implementing the recommendations. It can also bring them under the ambit of action. The Commission has such a right. The Commission can blacklist those who do not implement the recommendations. That is why the Commission itself can also play an effective role in implementing its recommendations.
