Short term interim order to stop permanent promotion process of Gandaki University

The Pokhara High Court has given a short-term interim order to stop the process of giving permanent appointment to contract employees in Gandaki University. On Chait 15, the court issued a short-term interim order to stop the process until the two parties discuss the writ filed by advocate Manoj Gharti Magar.

The court has called both sides for a discussion on March 20 to decide whether or not to issue an interim order. In addition, due to the fact that the order should not be issued as requested by the petitioner, the time has been given to the opponent to send in writing within 15 days .  In the

letter, the university's Board of Trustees, Executive Council and its then coordinator outgoing Chancellor Prof. Dr. Ganeshman Gurung, Manpower Management Committee and its Coordinator, Office of the Chief Minister and Council of Ministers, Ministry of Social Development, Youth and Sports, Gandaki was made the opposition.  

Senior Advocate Bishnu Prasad Sharma, Deepak Bastola, Advocates Kapil Mani Dahal, Bimal Prasad Lamichhane, Dinesh Acharya, Khimnath Timilsana, Pradip Kumar Rana, Manoj Gharti Magar, Milan Ale, Sujata Dhakal argued on Sunday.  

The manpower management committee of the university requested applications for 78 administrative, academic and unranked posts on February 1. In the notification, it was said that the employees working in the university will be filled by 'special internal competition'. 

Gandaki University Teachers and Staff Regulations, 2077 does not envisage other than the appointment of contract employees, so the petitioner claims that special internal permanent posts are against the law . The petitioner claims that the arrangement that outsiders are not allowed to participate in the competition is discriminatory. It was claimed in the writ petition that the notice published to perpetuate the contract when the tenure of the Chancellor was 2 days left was selfish and with wrong intentions. Chancellor Prof. Dr. Ganeshman Gurung's tenure ended on February 3.

University registrar Dr. Kailash Timilsina said that the advertisement was issued as per the decision of the Judicial Council to make the establishment employees permanent. He claimed that the advertisement issued by them is in accordance with the law as regulations have been made to make it permanent. The Judicial Council has made regulations. Therefore, it is according to the law," he said to Kantipur, "We keep everything there on the day the court calls us."
