Recommendation to court to expel 768 Nepalis from America

In the first four months of 2025, 768 Nepalis have been recommended to the immigration court to be deported from America.

The US Immigration and Customs Enforcement (ICE) has recommended to the court to terminate the deportation proceedings against them, saying that they are residing illegally.

According to the data of the Executive Office for Immigration Review (EOIR), 235 people were referred to the court in January, 239 in February, 194 in March and 100 in April. The data since May has not been made public.

US Citizenship and Immigration Services (USCIS) has a provision to recommend to the court for removal if the refugee or resettlement process is denied, Temporary Protected Status (TPS) expires or there is no immigration status, according to the EOIR. ICE has a provision to recommend to the court for deportation orders for asylum seekers who enter the United States without a visa and request residence and other persons who violate immigration laws. 

According to the USCIS, not all those recommended in the court will be deported and some who complete the process according to the law may even receive a green card. "Some people who cannot obtain a green card are ordered to be deported, and those who receive such an order must leave the United States," USCIS said, "this arrangement may not apply to immigrants who have been living in an undocumented state illegally since entering the United States." 

President Donald Trump has tightened the policy of deporting illegal immigrants after starting his second term on January 20. Because of Trump's strictness, 163 Nepalis have been expelled in 6 months since his term began. From January to May, 146 men and 17 women were deported from the United States. The Trump administration expelled 45 people from the chartered plane twice and handed over the rest from the regular flight to the Tribhuvan International Airport immigration office. 1,365 Nepalis were on the list to be deported. 163 of them were expelled. 

The Trump administration is also speeding up the legal process to deport illegal immigrants. The Trump administration, which has been giving strict instructions to ICE to arrest and deport undocumented immigrants, has accelerated the legal process to increase the number. President Trump has repeatedly instructed Ice to control undocumented immigrants at the rate of 3,000 per day, saying that he is focused on completing his plan. According to the instructions of the Trump administration, the number of illegal immigrants who are arrested and deported is also increasing. Even during the tenure of former President Joe Biden, 8,911 Nepalis were recommended to the court by issuing a 'Notice to Appear' for deportation.
