The body of 38-year-old Janaki Dhamala of Kalekanda, Panchadeval Binayak Municipality-9, who chose the path of death without receiving justice for seven years, has been lying at the hospital for seven days.

She committed suicide at home on Poush 10, saying that she had not received justice. Janaki's body has been kept at the district hospital for 7 days. Janaki's family has not yet recovered the body, saying that her husband had remarried and was living in India and had not returned even after receiving news of Janaki's death. Janaki's uncle, Kamalbazar Municipality-5 Ward Chairman Satyaraj Timilsaina, said that she was forced to commit suicide by her husband, in-laws and family, physically and mentally tortured. Janaki's family is adamant that they will not accept the body until Janaki's husband arrives. Janaki's grandfather, Hari Prasad Timilsaina, said that Janaki's husband does not want to come and the police are also pressuring the family to recover the body. ‘If you are coming to pick up the body kept at the district hospital, come, otherwise the police will have to send you,’ he said, ‘The police are adding more pain to the pain. It does not seem that any attempt has been made to bring her husband.’ Her uncle, ward chairman Timisaina, said that the family members were delaying the pick-up of the body. ‘We had repeatedly reminded her that if it is difficult at home, stay with her family.’ Her married daughter used to say that it is embarrassing to stay with her family. She wanted to build a good relationship with her husband and live in her own house,’ Satyaraj said, ‘We will not pick up the body until Janaki’s husband comes and takes the body.’ Even though we received news that he would arrive three days ago, he has not arrived here yet.’ On Poush 27, Janaki had wanted to see just a glimpse of her daughter as a mother on her birthday. But when that wish could not be fulfilled, she chose the path of suicide that same night. She wrote that she ended her life because she could not bear the burden of constant rejection, social exclusion and mental exhaustion from her family. 

Her husband Chandra Dhamala was living in India for employment.  Janaki found out about his second marriage in India 7 years ago. After receiving the news that he had married again without her knowledge, she reached the district headquarters Mangalsen. Her struggle, which began after her husband married for the second time, was entangled between the court, society and state bodies for 7 years.

On Asoj 25, 2077, the case related to polygamy was registered in the Achham District Court.  The court ruled against Janaki, considering the lack of evidence.  

According to the Achham District Court, her case was adjourned on Chaitra 7, 2077.  And, it was adjourned on Jestha 2, 2081.  On Bhadra 2081, the bench of District Judge Prakash Dhungana acquitted Janaki's husband and the woman he allegedly married, Rabina Joshi, saying that the claim was not substantiated.

On Jestha 22, the bench of High Court Dipayal Judges Dandapani Sharma and Asmin Kumar Rai overturned the case of the District Court Achham. Both Chandra and Rabina were sentenced to one year in prison and a fine of Rs 10,000. After paying the amount equivalent to the sentence using Section 155 of the Criminal Procedure Code 2074, the husband was released without serving any jail time. Rabina is still on the absconding list. Legally, the sentence was considered to have been completed. But from that day on, Janaki's life became more unsafe.

After paying the amount of the prison sentence, Chandra filed a divorce case in the Achham District Court on Ashoj 20. 'Her husband had been pressuring Janaki to take Rs 10 lakh and separate.' She (her niece) started saying that she had married for love and that she wanted children and a husband, not money,” said her uncle Satyaraj. “She was prevented from meeting her children. She was practically deprived of her role as a mother. This situation became the biggest blow for Janaki, who was seeking justice.”
