An easy legal arrangement is going to be made to make permanent the employees who have been hired in temporary or contractual service at the local level in Far West. The provision mentioned in the report prepared by the Legislation and State Affairs Committee and submitted to the State Assembly has been sharply criticized.
Bill 2081 made to regulate the formation, operation and service conditions of the Far West Province local level has brought waves.
In the bill submitted to Speaker Bhim Bahadur Bhandari after a long discussion by the Legislation and State Affairs Committee, it is mentioned that 'for those appointed on temporary or contractual basis before the implementation of the Far West Province Local Service (Formation and Operation) Act, for the first time after the implementation of the Act, the Provincial Public Service Commission will fill the posts only through internal competitive examination.
After the passage of this Act, hundreds of temporary and contractual employees who are in approved positions at the local level in Far West will be allowed to compete only among themselves. Critics say that the Public Service will fill the posts through a separate internal competitive examination targeting such employees, which will benefit limited employees.
The bill, which was drawn into controversy at the beginning, was sent to the Legislation and Provincial Affairs Committee on July 29 for quarterly discussion from the tenth session of the Provincial Assembly. The Provincial Assembly Secretariat said that the report prepared by the committee after 28 meetings to discuss the said bill was submitted to Speaker Bhim Bhandari. Another controversial issue in the
bill is employee promotion. The proposed bill has made it easy for the promotion of the employees appointed to the authorized sixth and eighth level positions in the approved posts of the local bodies.
It is mentioned that "If the employees who were appointed to the official sixth and eighth level positions in the approved posts of the previous local body and have been adjusted to the local level have reached the minimum educational qualification required for the higher level, the authority will once again maintain the authorized seventh and ninth level of the local service". Also, in that provision, it is said that 'the seniority of the level where the level is matched will be applicable from the date of the first appointment'.
In the promotion process, the seniority of the past is maintained, the employees who have passed through the Public Service Commission are in Chepuwa situation. While increasing the level of employees who have been adjusted at the local level, it has only been mentioned about the employees in the domestic and small industry development committee, district development committee, municipality and village management. They complain that the civil servants who passed the competition from the Public Service Commission were beaten. Prakash Rawal, a member of the United Samajwadi Party who is a member of the
committee, said that the report was submitted based on the consensus that the temporary or contract employees who have been working for a long time in permanent positions will have an internal competition for one time. "Everyone has their own interests, if there is opposition, there is an opportunity to remove the provision from the meeting of the Provincial Assembly," Rawal said. Another member of the
committee, Maoist MP Ramesh Singh Dhami said that due to internal disputes within the party, he is not active in any committee and is against the mentioned provisions. Another member of the
committee, the ruling UML MP Janaki Air Bomb, claimed that the members of the committee had no malice behind the provision. It is heard that a dispute has arisen now. But it is the intention of the members of the committee that we should also think about the employees who have been working on temporary or contractual basis for a long time,' she said, 'There will be a detailed discussion in the state assembly meeting.' "Is it possible to bring a law to ban public competition?," said the young Royal Joshi who protested at the main gate of the provincial assembly, "We will not allow such a provision to be implemented."
