The Supreme Court has ordered the release of former Prime Minister KP Sharma Oli and Home Minister Ramesh Lekhak from custody after the expiry of the five-day extension extended by the Kathmandu District Court. The District Court had extended the detention period for the third time by five days, effective from 21 Chaitra.
Oli and Lekhak will be released from custody on 26 Chaitra with this order given by the bench of Justices Binod Sharma and Sunil Kumar Pokharel.
The Prime Minister and Home Minister were taken into custody for investigation during the Gen-G agitation on 23 and 24 Bhadra.
The police had arrested Oli and Lekhak on 14 Chaitra, saying that they would be investigated, following the recommendation of the former Justice Gauri Bahadur Karki Commission. The police had issued an urgent arrest warrant and arrested them, and on 15 Chaitra, they were presented to the Kathmandu District Court for permission to detain them. Claiming that the police arrested them without even obtaining an arrest warrant from the court, the family of Oli and the writer had filed a petition for custodial interrogation in the Supreme Court.
The Supreme Court made this order while holding the second hearing on the petition. The police are investigating them by extending their remand from the district court. The police arrested them quoting Sections 181, 182 and 183 of the Criminal Code. The section states that ‘negligent killing shall not be permitted’. It states that killing someone through negligence can result in imprisonment for up to 3 years and a fine of up to 30,000 rupees.
A cabinet meeting held within hours of Prime Minister Balen Shah taking oath had decided to implement the report of the inquiry commission submitted by the Gauri Bahadur Karki-led commission in cases other than security personnel. After arresting Oli and the writer, Home Minister Sudan Gurung had responded that it was not for revenge but for justice.
