Nominations are being registered in 165 constituencies for the direct election to the House of Representatives on Tuesday. The Election Commission has stated that all preparations for the registration of candidacies have been completed.

The commission has stated that all preparations have been completed and election officers have been deployed in all areas. The nomination will be held at the office of the election officer of the concerned area, said commission spokesperson Narayan Prasad Bhattarai. The commission has also implemented the election code of conduct from Monday before the nomination of candidates.

The commission has drawn attention by saying that no one should do anything that is against the code of conduct. The commission will also take a commitment from all those who file their candidacies to follow the code of conduct along with the nomination.

According to the House of Representatives Election Act, only Nepali citizens whose names are included in the voter list can file their candidacies. It is said that the candidate must be 25 years of age, not disqualified under federal law, and not holding any position of profit.

Those who want to be a candidate must also submit a copy of their citizenship or voter ID card, and proof of resignation from such a position if they were employed in an organization run by the government or government grants, along with the nomination paper.

If a person who wants to be a candidate cannot attend in person, they can nominate their candidacy by appointing an election representative. For that, the notification issued by the commission states that the representative must send the prescribed form along with the nomination as per the format prescribed in the House of Representatives Election Guidelines.

The candidate will have to submit a nomination form with the names of one proposer and one seconder included in the voter list of the relevant constituency and signed in full. Those who are candidates on behalf of a party must also include the formal letter of nomination received from the party. The parties have already submitted the names and sample signatures of the officials who will sign the nomination form to the commission.

The candidate will have to deposit a deposit of Rs 10,000. There is a legal provision that there is a 50 percent discount on the deposit amount in the case of women, Dalits or minority communities or economically disadvantaged candidates. Spokesperson Bhattarai said that in the case of economically disadvantaged candidates, a letter recommending them as poor by the concerned local level should be included. It has been said that the self-declaration prepared by the commission for the candidate must also be submitted along with the nomination.

The candidate will have to declare that he/she has not paid any government dues, has not been convicted of any corruption-related offense, has not been sentenced to imprisonment or fine by a judicial body, has not been arrested but has not absconded, and has not obtained a foreign permanent resident permit (DV/PR).

Similarly, a form filled with property details in the format prescribed by the commission must be submitted to the office of the election officer along with the nomination. Spokesperson Bhattarai said that the candidate should reach the office of the election officer during office hours by attaching the proposer, seconder, deposit amount and prescribed documents. There are 114 political parties registered with the commission to participate in the direct election. 

57 parties have submitted their closed lists of candidates for the proportional election. There is a constitutional provision that 165 members of the 275-member House of Representatives will be directly elected from 165 constituencies, while 110 seats in the proportional system will be elected on the basis of the estimated votes received by the party.

What is required to file a candidacy?

–Name on the voter list, 25 years of age or older, not disqualified under federal law and not holding any position of profit

–Copy of citizenship or voter ID card, proof of resignation if employed in a government or government-funded organization with remuneration

–10,000 rupees bail, but 50 percent discount on bail for women, Dalits, minority communities or economically disadvantaged people

–No government dues or fines outstanding, no corruption-related cases pending, no imprisonment or fines imposed by a judicial body pending, no absconding despite arrest warrant issued, self-declaration of not having obtained a foreign permanent resident permit (DV/PR)
