The policy arbitrariness of the government and the indifference towards constitutional values has been highlighted by the news titled "The President has returned the Constitutional Council Bill saying that it is unfavorable to the Constitution at first sight".
Although the bill with the controversial provision that only 2 members can be appointed to the 6-member constitutional council was passed by the parliament, the president sent it back for reconsideration saying that it is against the essence, spirit and democratic principles of the constitution at first glance. This is also a strong warning from the head of state on the government's attack on the supremacy of the constitution and the principle of separation of powers.
In the message of the President, the emphasis on the unanimous decision-making process, the 48-hour notification provision and the provision that the President can call a meeting in a short time reflect the intention of weakening the Council and increasing the government's arbitrariness. This provision, which legitimizes the sole decision of the Prime Minister and nullifies the role of other members, is sure to make the appointment process of the constitutional body a means of political participation instead of making it fair and transparent.
This step of the government is the height of irresponsibility towards the constitution. It is objectionable that the government, which has misused the ordinance in the past, is again trying to weaken the constitutional practice. It is inevitable that the government should immediately address these serious questions raised by the President and bring a bill in accordance with the spirit of the Constitution. Otherwise, the government will go down in history as guilty of attacking the Constitution.
