Formulas for the Effectiveness of Parliamentary Committees

A parliamentary committee is a specialized form of assembly. Parliamentary committees are formed to increase the effectiveness of the government and constitutional bodies while maintaining parliamentary control and regulation over the government by making it accountable to the parliament. At present, 16 committees are active in the Federal Parliament. All committees have their own scope and working conditions.

The committee works according to the specified agenda. The committee conducts detailed discussions on the bill, monitors the agencies under its jurisdiction, invites stakeholders to meetings and discusses them, hears complaints and grievances in the field. Likewise 

There is also the work of studying the delegated legislation under their jurisdiction, auditing the law, checking the revenue and expenditure estimates of ministries, departments and agencies and preparing annual estimates. The parliamentary committee also does the work of giving necessary instructions to the relevant agencies regarding the alternative policy that can be adopted instead of the policy contained in the annual estimate and how much money can be saved in the annual estimate. 

Monitoring and evaluating the work of the Constitutional Commission and giving a report, monitoring and evaluating whether the directives given by the committee have been implemented and submitting the report to the assembly, studying whether there is embezzlement of public property of the government agencies related to the work area, monitoring and evaluating and giving necessary instructions and reporting to the meeting are also within the mandate of the committee. The task of studying what steps have been taken by the Government of Nepal to fulfill the assurances given by the Ministers on behalf of the Government in the meeting and giving necessary instructions to the concerned bodies is also under the scope of the committee. The work to be done by the parliamentary committee can be made effective in various ways. The

committee is the active arm of the assembly. Building strong committees gives more energy to the legislature, oversight and democratic representation. Therefore, when recommending members to the committee, the political party represented in the parliament should emphasize on issues such as previous experience, interest, ability, and expertise.

The agenda of the meeting, its raising and the discussion in the committee remain important. Equal and neutral role of chairman, use of expertise of all members, equal opportunity, sharing in decision making, active in discussion make committee activities effective. The

committee should monitor, discuss and receive information and give reasonable instructions on the physical and financial achievements of the relevant ministries, constitutional bodies and other departments within their scope and working conditions. 

There should be a comprehensive discussion on the reports of the ministerial and constitutional bodies in the relevant committees. The committee should make a work schedule and proceed with the work related to the bill in order to bring the process of discussion and report submission of the bill to a timely conclusion without delay.

Committee should be knowledgeable about the context, implementation, impact of the policies under their jurisdiction. The committee should measure the implementation of laws within its jurisdiction. Through this, the state of law enforcement, complexity and areas of improvement are identified. Also, the committee can also study the delegated legislation.  The

committee also conducts on-site study of the agencies under its jurisdiction, listens to complaints, discusses with stakeholders, identifies cause and effect analysis of problems and gives directions for improvement. The committee should prepare a roster of experts in their field and take assistance, consultation and suggestions as needed.  Committee activities can be made effective by managing, studying and using reference materials such as policy, legal and delegated legislations and study-research reports, journals, periodical publications, data bank studies under the scope of

committee. The study given by the

committee should be legal, practical and implementable. According to the study-research report, the committee's decision is only partially implemented. In this, the government should be held accountable and the decision given by the committee should be relevant, practical, within the scope of policies, methods, resources and standards.  The core function of the

committee is also parliamentary oversight. The sources of guidance given by the committee are discussions of committee meetings, learning from parliamentary monitoring, existing situation survey, analysis of study reports. The instructions given by the committee should be of a nature to produce results, improve quality and change the situation. 

In particular, committee members tend to work in a collective manner and avoid partisan polarization. There should be a cooperative relationship between the committee and the media to communicate the activities of the committee and the work done by the people's representatives for the people. The

committee has its own procedures. According to the procedures, the committee should be active in discussion, guidance and monitoring to discuss and report on the bill and make the relevant agencies responsible. Bilateral, multilateral international learning experience sharing is important to make the committee effective.

The committee process is important to make the relationship between the government and the parliament regular, balanced and orderly.
