The Patan High Court has upheld the Kathmandu District Court's decision to convict three members of the then Constituent Assembly in the case related to misuse of red passports and forged documents.
A joint bench of Justices Khadka Bahadur KC and Gopal Prasad Bastola on Ashad 23 upheld the district court's decision to convict Constituent Assembly members Gayatri Sah, Bishwanath Prasad Yadav and Shivapujan Raya Yadav. According to Patan High Court Information Officer Govinda Prasad Koirala, the high court has upheld the district court's decision to sentence the three members of the Constituent Assembly to five months in prison and a fine of Rs 500 each. The Kathmandu District Court had pronounced the decision on Jestha 21, 2071.
The police had accused the three members of the first Constituent Assembly, 2064, of selling special diplomatic passports they had received in their capacity to middlemen for financial gain. The court has also found Dil Bahadur Gharti, Gopal Baniya, Manoj Kumar Karki, Devendra Poudel and Santosh Raj Upreti guilty of the same charge of forged documents and sentenced them to one year in prison and a fine of Rs 554,000 each.
The Kathmandu District Court had sentenced Prithvi Chantyal of Myagdi to one year in prison and a fine of Rs 500 for trying to travel to Australia using a fake passport. The High Court has upheld the same decision.
