The Department of Foreign Employment has decided not to renew the manpower companies that do not resolve complaints. Such companies will not be allowed to send workers for foreign employment from next July 1.
The department has adopted a policy of not renewing the manpower to resolve complaints that have been pending for years. ‘The department is trying to conclude the case and investigation work as soon as possible,’ said Meera Acharya, Director General of the department, ‘Now is the time to renew. If the complaint is not resolved at the time of renewal, it will not be renewed.’
The department has already informed manpower entrepreneurs about this. The department has pending complaints since 2057 BS. There are about 44,000 such complaints, both institutional and individual. The largest number is individuals.
There is a process where the individual takes personal responsibility for obtaining a labor permit without obtaining a labor permit from the manpower company. Workers who have been cheated have been filing complaints against individuals.
The biggest challenge for the department is to resolve individual fraud. If the department is unable to resolve the case through mediation, it has been submitting it to the Foreign Employment Tribunal.
The department says that it is going to manage the details of how many complaints have been filed against which company. ‘We have divided the complaints into two parts, before and after 2080.’ After dividing them in this way, we are working to address them through public notice,’ Acharya said, ‘The work of collecting evidence in the complaint is underway. This is being strictly implemented.’
Complaints have been filed in the department on issues such as taking more money than specified, doing work contrary to what was mentioned in the contract, not getting paid, and doing different work. In the case of complaints where evidence is available, the department deducts the amount from the deposit kept by the manpower company and gives it to the victim. The department has cash and bank deposits of manpower companies ranging from Rs 20 million to Rs 60 million.
The department has stated that it has tightened the law regarding providing relief and compensation to the victim. ‘The clause protecting workers is strict. If it is found that more money has been sent from just one person, a fine of Rs 50,000 will be imposed per person. If more money has been sent from 100 people, a fine of Rs 5 million will be imposed,’ she said. ‘In such a situation, the manpower company itself should appear at the department and settle the complaint.’
The department has stated that all the complaints in the name of manpower companies will be completed by mid-Asad and complaint management will be made effective from Shrawan. The department is preparing to create a separate mechanism to receive new complaints from Shrawan. ‘The department cannot handle all types of complaints. We are working to ensure that such cases and investigations reach more important and expert bodies than the department,' said Acharya, Director General of the department. 'From Sharan, case investigations and relief and rescue issues will be managed through a new system.' The department has also instructed manpower companies to continuously monitor the workers they send and submit details every three months. 'In the context of repeated complaints from Nepali workers about various problems such as not receiving salaries and other services and facilities as per the employment agreement, not providing safe and suitable accommodation, and being forced to do other work contrary to the agreement, instructions have been received from the Office of the Prime Minister and the Council of Ministers to effectively protect the rights, interests, security and labor rights of Nepali workers,' the directive issued by the department said. 'The licensed organization shall clearly and regularly monitor/cause to be monitored the condition of each individual and group of workers it sends for foreign employment.' The department has stated that if workers abroad face any problems or situations that are contrary to the agreement, the concerned licensed organization will immediately conduct a hearing and proceed with the resolution process. If a Nepali worker needs to be rescued, the department will immediately contact the concerned agency to arrange for rescue and compensation.
