The Special Court Kathmandu and the High Court Janakpur have started ‘live streaming’ of the hearings held in the bench. The Special Court started ‘live streaming’ on Tuesday and the High Court Janakpur on Sunday. Preparations are also underway for ‘live’ in the Supreme Court. 

Supreme Court spokesperson Arjun Koirala said that ‘live streaming’ has been started in the Special Court and the High Court Janakpur in the first phase. ‘In the second phase, there are preparations to broadcast the hearings held in the Constitutional Bench of the Supreme Court live,’ he said, ‘this process will gradually increase and spread to the district courts with a large number of cases.’ He informed that the process of formulating procedures has also been moved forward to bring uniformity in this. 

The debate held in the Special Court on Tuesday for the extension of the term of UML leader and former minister Bishnu Poudel, who was arrested on charges of money laundering, was broadcast live. The Special Court broadcasted it live on a TV set in the ‘live room’ outside the bench. Two days ago, the High Court, Janakpur, also started live broadcasting of the proceedings of the bench through its YouTube channel, except for cases that are heard in closed session, require confidentiality, and have an adverse impact on public peace, order, and national security. 

Under the leadership of Acting Chief Justice Tek Narayan Kunwar, Janakpur started live broadcasting before Kathmandu. Before that, when he was the chairman of the special court, he had proposed it and prepared the infrastructure for the special court. The court has stated that 'live streaming' and 'recording of court proceedings' were possible on the basis of that preparation. Acting Chief Justice Kunwar said that the main objective of live broadcasting of the hearings in the bench is to make the judicial process more transparent, accountable, and accessible to the public. 

In the fifth five-year plan of the Supreme Court, it was mentioned that the hearings of all cases to be heard in open session would be broadcast live from Mangsir 2082. But it was being stopped due to lack of preparation. Koirala, the spokesperson of the Supreme Court, said that the Supreme Court building was set on fire during the protest on Bhadra 24 last year, and it was pushed back again.

Chief Justice Manoj Kumar Sharma had last mentioned the concept of 'live streaming' and 'e-court' during the parliamentary hearing for his appointment on Jestha 5. He mentioned in his action plan to make the judiciary technology-friendly and transparent. About a month later, the 'streaming' of hearings began in two courts.

'Trial live streaming' is being tested in the Supreme Court. The Supreme Administration has stated that it is preparing to make it regular after the test is successful.

Nepal Bar Association Secretary Advocate Baburam Aryal said that only some important cases and hearings of constitutional benches should be broadcast live, and not all cases. He said that the Supreme Court itself should develop a medium for this, not on social media like YouTube. 'What will happen if YouTube is banned in Nepal if we broadcast live directly from YouTube? What will happen if it is captured and misused without authorization? "A procedure should be made regarding which cases should be broadcast live and how," he said. 

A writ petition filed by Bivek Chaudhary on 28 Bhadra 2081 was under consideration in the Supreme Court. The first hearing of the writ petition filed by Bivek Chaudhary on 31 Bhadra was held. The bench of Justice Kumar Regmi had issued a show cause order to its own administration and had also granted priority to the case. The then Registrar of the Supreme Court, Bimal Poudel, had submitted a written reply arguing that additional infrastructure and resources were required for live broadcasting and that there was no prescribed law to organize and regulate broadcasting. He had also stated that the written reply was being prepared and that the matter was included in the strategic plan. The next filing of the writ petition has been scheduled for 7 Bhadra.
