The Ministry of Labor, Employment and Social Security has requested stakeholders not to employ anyone without an employment contract.

The ministry issued a press release today, clarifying that the ministry has drawn serious attention to the complaints and grievances received regarding the employment of doctors/health workers/nursing staff and other employees working in some hospitals and health institutions, as well as employees working in other establishments, without a labor contract as per the rules, and for more than the time prescribed by the prevailing law.

‘In Section 2 (n) of the Labor Act, 2074, ‘employment contract’ means an agreement between the employer and the worker regarding the services, conditions and facilities of employment’ and the word ‘also refers to the appointment letter given to the worker by the employer’.

The press release states that according to the law, employees cannot be employed for more than 8 hours per day and 48 hours per week, they cannot be forced to work overtime, and if they have to work overtime, they can be employed for no more than 4 hours per day and 24 hours per week.

The ministry has drawn attention to the need to fully comply with the prevailing laws. In addition, the ministry has stated that action will be taken in accordance with the Labor Act, 2074 BS if found to be in violation.
