The Supreme Court plenary session (all judges present) has issued a circular to the subordinate courts and judicial bodies not to stop emergency services during leave of more than 24 hours.

The plenary session held on Thursday decided to issue a circular to the High Court, High Court Benches, District Courts, Administrative Courts, Tribunals, Special Courts, Labor Courts, Consumer Courts, Juvenile Courts and Special Courts, and issued a circular to them on Friday.

The plenary session took this decision after the provision that ‘A person arrested under Article 20 (3) of the Constitution of Nepal shall be produced before the officer hearing the case within 24 hours, excluding the time and place of arrest, and the person arrested shall not be detained unless ordered by such officer’ was violated due to the leave.

The decision was taken by the plenary session following the government's recent decision to declare Sunday and Monday as public holidays. 'In the event that there is a situation where Saturday and Sunday are two (2) public holidays in a week and in other cases, if the holiday is longer than 24 hours, necessary arrangements shall be made during the holiday for the implementation of the above constitutional provisions and for the purpose of disposing of cases filed for permission to issue arrest warrants, urgent arrest warrants and permission to keep them in custody,' the Supreme Court circular states. Following the circular of the plenary session, courts and judicial bodies have to keep Saturdays and Sundays partially open as well.
