Former Prime Minister KP Sharma Oli's wife Radhika Shakya has filed a habeas corpus petition in the Supreme Court.

Shakya filed a habeas corpus petition on Sunday, alleging that Oli was illegally detained, and the petition will be filed on Monday, Supreme Court spokesperson Arjun Koirala said.

She has said that the court did not even take permission to arrest her and that the issuance of the necessary arrest warrant is unconstitutional. Shakya has said that Oli, who has become Prime Minister, should be released because he was arrested on charges of fleeing or destroying evidence without even starting an investigation.

According to her, another writ had been filed earlier. On Saturday morning, the police arrested Oli from his residence in Gundu, Bhaktapur.

He was arrested for investigation based on the report of the Commission of Inquiry related to the incidents that took place on 23 and 24 Bhadra. The police have presented the arrested Oli to the Kathmandu District Court through virtual means to obtain his remand. The government prosecutor has demanded his detention for 10 days.

The lawyers have argued in the bench of District Court Judge Anand Shrestha.

The court will order whether to extend the remand against him and former Home Minister Ramesh Lekhak.
