The Supreme Court has ordered an investigation into the murder of Kumar Poudel, a cadre of the CPN-Maoist's Biplav group. With the Supreme Court's order, the police will now have to investigate the FIR filed against the then Home Minister Ram Bahadur Thapa, Inspector General of Police Sarbendra Khanal, the then Chief District Officer Krishna Bahadur Raut and others.

What was the incident?
Kumar Poudel of Sarlahi Lalbandi was shot dead by security personnel on Asad 20, 2076 BS in the name of an encounter. The investigation committee formed under the coordination of the then Commissioner of the National Human Rights Commission, Govinda Poudel, had also determined that the incident was a murder and directed that everyone be brought to justice. At that time, the Home Minister of the government was Ram Bahadur Thapa Badal and the Inspector General of Police was Sarbendra Khanal.
A joint bench of Supreme Court Justices Dr. Manoj Kumar Sharma and Shrikant Poudel issued a writ petition in the name of the Ministry of Home Affairs, the Attorney General's Office, the District Police Office, Sarlahi, and the District Government Attorney's Office, Sarlahi.
Mother Durgadevi Poudel had filed a writ petition in the Supreme Court alleging that there was no investigation into the complaint. About five years later, a bench of Justices Dr. Manoj Kumar Sharma and Shrikant Poudel issued an order on Thursday to proceed with the investigation. Earlier, on 12 Asoj, 2078, the Supreme Court had also ordered an investigation into the complaint.
Along with the Supreme Court's order, an investigation should be proceeded with into the Kitani complaint filed in the District Government Attorney's Office, Sarlahi. Now, a criminal investigation should be conducted against former Home Minister and CPN-UML proportional list candidate Ram Bahadur Thapa Badal and former Inspector General of Police Sarbendra Khanal and the police officers involved in the incident.
What did the Human Rights Commission say?
A team from the Human Rights Commission had investigated after the incident. The family had requested the Human Rights Commission to investigate the case, saying that it was an extrajudicial killing but that it was a double confrontation. According to the commission's report, a team deployed under the direct direction of the Police Headquarters found that Poudel was killed.
When the Human Rights Commission prepared its report with the conclusion that Poudel was taken into custody and shot, questions were raised about the role of the then Inspector General of Police Sarbendra Khanal. And the Provincial Police Office of Province 2 was also in a coordinating role in the encounter. Which was led by AIG Hari Pal.
The commission's report states that after the police took Poudel into custody, 9 people were shot dead using unnecessary force. The commission said that the police claimed that it was self-defense and a double confrontation, but there was no confirmation from anywhere.
