The Judicial Council has sent a list of six judges to the Constitutional Council for the future Chief Justice. The council has sent the names of the senior-most judges of the Supreme Court, Sapana Pradhan Malla, Kumar Regmi, Hari Prasad Phuyal, Dr. Manoj Kumar Sharma, Dr. Nahakul Subedi and Til Prasad Shrestha, to the secretariat. According to a member of the Judicial Council, the Constitutional Council will recommend one name from among them.
This recommendation has been made as Chief Justice Prakash Man Singh Raut is about to retire due to the age limit of 65 years. Raut will retire from Chaitra 18. The council has sent the roster of six judges before that.
Article 129 of the Constitution contains provisions regarding the appointment and qualifications of the Chief Justice of Nepal and the judges of the Supreme Court. According to clause 2 of the said provision, the appointment of the Chief Justice and other judges of the Supreme Court on the basis of the recommendation of the Judicial Council and on the recommendation of the Constitutional Council shall be made by the President.
A parliamentary hearing will be held after the recommendation of the Constitutional Council. After the hearing is approved, the Supreme Court will get a new Chief Justice. According to the roll order, Malla is at the first position in the ranking.
