The Supreme Court has issued another order on a writ petition challenging Attorney General Sabita Bhandari's decision to amend the charge sheet against National Independent Party President and former Home Minister Rabi Lamichhane for money laundering and organized crime.
"Since it has been claimed that the decision to amend the charge sheet was taken after additional evidence was found after the charge sheet was filed, the additional original evidence documents found in relation to the amendment of the charge sheet should be submitted for discussion of the interim order as per the rules after they are collected from the Attorney General's Office," the order said.
The order was made during a hearing by a joint bench of Supreme Court Justices Manoj Kumar Sharma and Shrikant Poudel. The bench passed the order after the government claimed that the charge sheet was amended as per Section 36 of the Civil Procedure Code as additional evidence was found during the debate. Earlier, a single bench of Justice Abdul Aziz Musalman had sought a written response from the Attorney General's Office on Tuesday.
In a writ petition filed on Thursday by senior advocate Dinesh Tripathi, law students Ayush Badal and Yubaraj Poudel, the decision of the Attorney General's Office has been quashed, calling it 'prima facie illegal, malicious and arbitrary'.
