The Nepal Bar Association has demanded the immediate withdrawal of the Attorney General's decision to withdraw the pending money laundering and organized crime cases against Rashtriya Swayamsevak Sangh (RSS) President Rabi Lamichhane in various courts.

 

Bar General Secretary Kedar Koirala has issued a statement saying that this decision will violate the rule of law . Attorney General Savita Bhandari had decided to allow the District Government Attorney's Office to amend the two charges against Lamichhane pending in courts across the country . 

'The decision to withdraw the case is against the prevailing legal system and the principles previously propounded by the Supreme Court regarding withdrawal of cases . Such a selective decision will also affect the jurisdiction of the court and affect the concept of an independent judiciary,' the Bar said,  'It is clear that this issue will bring serious deviations in the criminal justice system itself, violate the rule of law and promote the arbitrariness of the executive . We oppose the decision to ensure the rule of law as the politicization of crime and the criminalization of politics encourage impunity and kill the spirit of criminal justice.'' The Bar has also demanded the Attorney General to immediately withdraw the aforementioned decision.''

''It has been decided to approve the decision made by the Attorney General's Office on 30th of Pus... to uphold the charges claimed for fraud and cooperative fraud and amend the charges in accordance with Section 36 of the National Criminal Procedure Code, 2074 BS...'' The Bar has stated that the decision essentially withdraws the case of organized crime and money laundering out of the three cases, and therefore draws serious attention to this matter.
