The Supreme Court has dismissed the writ petition filed against the Commission of Inquiry formed to investigate the incidents of 23 and 24 Bhadau.
A bench of Supreme Court Justices Manoj Kumar Sharma, Nahakul Subedi and Shrikant Poudel issued a directive order on Friday, dismissing the writ petition. On Kartik 18, advocate Bipin Dhakal had filed a writ petition against Commission Chairman Gauri Bahadur Karki, members Vigyanraj Sharma and Bishweshwor Prasad Bhandari, questioning the impartiality and propriety of the commission.
The writ petition claimed that Karki and Sharma should not be allowed to sit on the committee as they had shown bias by making their views and opinions public about the subject of the inquiry. The writ petition argued that the officials of the inquiry commission should exercise their judicial mind and that they could not work without bias since they had already made their views public about the incident.
The government had formed a commission of inquiry under the leadership of former Special Court President Karki to investigate the loss of life and property caused by the Gen-G movement. The commission includes former AIG Vigyanraj Sharma and advocate Bisheshwar Prasad Bhandari, who has worked in UN missions.
The commission has established a secretariat in the old Prime Minister and Council of Ministers Office, which was damaged by arson. The Supreme Court has given this verdict at a time when the commission is busy taking statements. With this, the commission officials will be able to work easily.
