A case has been filed in the District Court, Kathmandu against the then Secretary of Nepal Trust Karki, Joint Secretary Lekh Bahadur Karki, Chairman of Thamserku Trekking Pvt. Ltd. Lhakpa Sonam Sherpa and Thamserku Trekking Pvt. Ltd. Based on the investigation conducted by the Central Investigation Bureau (CIB) of Nepal Police, a case has been registered for fraud. The investigation report sent by the CIB with its opinion also demanded that the accused be made a defendant for organized crime and criminal breach of trust.
A claim of Rs 4.86 billion 2.55 billion has been claimed against them for causing damage by entering into an agreement contrary to the proposal made by Thamserku earlier. Similarly, an additional amount of Rs 5.324 million has been added for allowing the use of the land on the road of plot number 4605.

However, after completing the investigation, the CIB had submitted a report recommending that the former joint secretary, former secretary and Sherpa be made defendants.
The board meeting of Nepal Trust had first approved the plan to lease one ropani and 14 aanas of land on Durbar Marg on 28 Shrawan 2071. About 2 years later, a public notice was issued and bids were invited for the lease of the land. In that process, Thamserku had submitted a proposal of Rs 6.26 billion to lease one ropani and 14 aanas of land in front of Narayanhiti Durbar. However, on 24 Falgun 2073, it had written an application and proposed to reduce the old proposal to Rs 1.40 billion, saying that it could not provide such a large amount.
At that time, the second successful bidder in the technical proposal was Sakhat Steel Industries Pvt. Ltd. and Adrisiya-Lianz JV had proposed Rs 622 million and 2458 thousand, respectively. The officials have concluded that Thamserku had reduced his proposal after learning about that.
When the evaluation committee called for a settlement after Thamserku's offer of Rs 6.26 billion, Thamserku's application reached the Nepal Trust's legal department. However, at that time, the then legal deputy secretary of the legal department, Purushottam Khatiwada, had submitted a note on 20 Chaitra 2073, stating that the security deposit of Thamserku Trekking had also been forfeited. The CIB had also submitted this letter as evidence.
