Madhesh Province government formation dispute: Final hearing to begin today

The final hearing on the writ petition filed by the majority of MPs against the formation of the Madhesh Province government is starting today. The hearing has been scheduled in the bench of Justices Hari Prasad Phuyal and Nityanand Pandey. The hearing has been scheduled for the first time.

Earlier, the joint bench had fixed the date of the final hearing. The Supreme Court is preparing to give a final decision after continuous hearing if the case cannot be heard due to inaccessibility or for any other reason. The Supreme Court had given priority to the hearing, saying that it should be concluded immediately. The writ filed by 74 lawmakers in the Madhesh Province Chief Minister dispute is about to be debated by both sides. 

The dispute reached the Supreme Court after the provincial chief appointed UML lawmaker Saroj Kumar Yadav as the Chief Minister in the hotel.    Similarly, the Supreme Court had ordered the submission of the entire file related to the appointment of UML lawmaker  Yadav as the Chief Minister on Kartik 23. After that, the hearing was scheduled but the hearing has not been held. 

74 lawmakers other than UML had reached the Supreme Court demanding that the decision to make Yadav the Chief Minister be nullified. An interim order was also issued last Tuesday in this dispute. The Supreme Court also asked Saroj Kumar Yadav, who was appointed as the Chief Minister, not to make long-term decisions.

Congress parliamentary party leader Krishna Prasad Yadav, JSP Nepal parliamentary party leader Saroj Kumar Yadav, Maoist Center parliamentary party deputy leader Yubaraj Bhattarai, LOSPA parliamentary party leader Jayalun Rai and other leaders have reached the Supreme Court.

There are 107 MPs in Madhesh Province. 54 MPs is the majority number to form a government. UML has 25 including the Speaker, Congress 22, JSP 19, Janmat 13, Maoist 9, LOSPA 9, CPN (S) 7, Federal Socialist Party, RPP and Nagarik Unmukti Party have 1 MP each. Of these, UML MP Dipendra Thakur, JSP MP Saroj Singh Kushwaha, LOSPA MP Abhiram Sharma are suspended. The current number of members in the Madhesh Province Assembly is 104.

The provincial chief administered the oath of office to UML leader Saroj Yadav as the chief minister early Monday at a hotel in Bardibas. The controversy has reached the court after it was criticized as politically, constitutionally and morally wrong.
