A hearing has been scheduled for the first time in the bench of Justices Nahakul Subedi and Sunil Kumar Pokharel to hear the writ petition filed by the majority of MPs against the formation of the Madhesh Province government. Today's hearing has been scheduled for the first time.

 

The second hearing is going to be held today . Although the case was scheduled for presentation on Monday, the hearing was stopped due to lack of time . The Supreme Court has been prioritizing the presentation, saying it needs to be resolved immediately . The writ filed by 74 lawmakers in the Madhesh Province Chief Minister dispute is going to be debated by both sides . 

The dispute reached the Supreme Court after Province Chief Sumitra Subedi Bhandari appointed UML MP Saroj Kumar Yadav as the Chief Minister in a hotel.  The Supreme Court had ordered the entire file related to the appointment of Yadav as the Chief Minister on Kartik 23.  After that, the presentation of the hearing was scheduled but the hearing has not been held . 

74 lawmakers except for the CPN-UML had reached the Supreme Court demanding that the decision to make Yadav the Chief Minister be nullified. An interim order was also issued last Tuesday in this dispute. The Supreme Court also asked Yadav, who was appointed as the Chief Minister, not to make long-term decisions  The leaders including Nepali Congress parliamentary party leader Krishna Prasad Yadav, JSP Nepal parliamentary party leader Saroj Kumar Yadav, Maoist Center parliamentary party deputy leader Yubaraj Bhattarai, LOSPA parliamentary party leader Jayalun Rai had reached the Supreme Court.

There are 107 MPs in Madhesh Province. 54 MPs is the majority number to form a government. UML has 25 including the Speaker, Congress 22, JSP 19, Janmat 13, Maoist 9, LOSPA 9, CPN (S) 7, Federal Socialist Party, RPP and Nagarik Unmukti Party have 1 MP each. Of these, UML MP Dipendra Thakur, JSP MP Saroj Singh Kushwaha, LOSPA MP Abhiram Sharma are suspended. The current number of members in the Madhesh Province Assembly is 104.
