The Tulsipur, Butwal bench of the High Court has ordered the withdrawal of evidence files from the Supreme Court on a petition filed by Rashtriya Swayamsevak Sangh (RSS) President Ravi Lamichhane seeking relief from the cooperative fraud case by paying his share of the amount.

The joint bench of Chief Justice Basudev Acharya and Justice Om Prasad Aryal of the Tulsipur, Butwal bench of the High Court has ordered the production of the evidence file, said the court's information officer Ram Bahadur Kunwar. This is the second time that the bench of Acharya and Aryal has ordered the production of the original file.

Earlier on Kartik 20, the bench of Justices Acharya and Aryal had ordered the production of the original file. After receiving a scan copy of the original file from the Supreme Court and a copy from the district court, the hearing was scheduled for Thursday. In the hearing on Thursday, Narayan Dutt Kandel, Mahendra Pandey and Dipendra Jha argued on behalf of Ravi.

Similarly, his son Rochak Joshi argued on behalf of Chhabilal Joshi. Joint Attorney Sandesh Shrestha and Deputy Attorney Prakash Marasini argued on behalf of the government prosecutor.

The bench on Kartik 20 had ordered to request the file of the main case. After the order, the district court sent a letter stating that the original copy had been sent to the Supreme Court and could not be provided. After the district's letter, the high court sent a letter to the Supreme Court to provide the original file.

The hearing scheduled for Kartik 13 was postponed after Chhabilal Joshi's legal practitioner filed a petition. Earlier, a bench of Justices Milan Kumar Rai and Om Prasad Aryal had ordered to keep both the cases of Chhabilal and Chhabi together as they were of the same nature.

When Lamichhane demanded to pay the amount as per the amount and fight the case outside the jail, the high court had ordered to submit the file of Chhabilal Joshi along with Ravi. Earlier, the Butwal High Court had ordered a complaint report in Lamichhane's case.

Despite the arson and vandalism of the Tulsipur Butwal High Court during the Gen-G protest, the case files of both Lamichhane and Joshi remained intact. Lamichhane, who was remanded in custody in the Supreme Cooperative Fraud case in Butwal, had filed a petition in the High Court on Bhadra 9 after the Rupandehi District Court did not release him even after he paid the amount of his share of the embezzlement in the cooperative. Earlier, he had filed a petition in the District Court demanding his release from the cooperative fraud case by paying the amount of his share. The bench of District Court Judge Narayan Sapkota had rejected his release after hearing his petition on Sharan 26.

A charge sheet has been filed against the defendants including Ravi in ​​the Supreme Cooperative fraud case in Butwal, setting a collective amount of Rs 109.936 crore. However, Lamichhane had submitted a document stating that he had paid one part of the amount out of four parts. Lamichhane had submitted a bank guarantee of Rs 27.484 crore with the application.

Like Lamichhane, Joshi had also submitted a guarantee for the same amount. However, since it was not clear how much amount would be fixed for both defendants, an order of the same nature was made that they should not be released.

Both Lamichhane and Joshi are in jail for pre-trial detention. Lamichhane, who is in Bhairahawa prison, has been transferred to Nakhkhu prison in Lalitpur, while Joshi is in Bhairahawa prison.
