Even though the rental agreement expired in 2075 BS, Khadka Land Pvt. Ltd. has been reluctant to vacate and return the land, and has not paid the rent regularly.
Nepal Scout has initiated the process of confiscating the structures built by Khadka Land Development Pvt. Ltd., owned by former Energy Minister and Congress leader Deepak Khadka, for not paying the land rent.
Scout published a public notice on Thursday stating that the Pvt. Ltd. has not paid the rent even after the sealing. The notice states that Scout has been given a chance to pay the outstanding amount within seven days as the Pvt. Ltd. has caused damage to the property.
If the amount is not paid within the said period, the building and equipment built on the Scout's land will be confiscated. If the rent is not sufficient even after confiscation, the notice states that recovery will be made from the house and property.
'The last chance has been given to pay the outstanding amount of rent within seven days. If the rent is not paid within the said period, all the buildings and goods constructed on the land will be confiscated as per point 4 of the agreement between Nepal Scout and Khadka Land Development Pvt. Ltd. and as per Section 619, 620 (4) and 621 of Chapter 12 of the Civil Code, 2074 BS, and the amount not reached even after the confiscation will be recovered from the house or property,' the notice states.
The Pvt. Ltd. had leased three ropanis of land located in the premises of Scout's central office in Lainchaur. Despite leasing three ropanis of land, the Pvt. Ltd. had been encroaching on and occupying about 12 ropanis of land. After the land rent was not paid on time, the District Administration Office, Kathmandu, sealed the said land and the buildings and structures built there on April 20, 2006 BS.
Even after the sealing, Khadka Land Pvt. Ltd. filed a case and repeatedly withdrew the case and did not pay the rent, causing irreparable damage, according to Scout. Scout had leased the land located next to the Department of Mines in Kathmandu Metropolitan City-29 to the Pvt. Ltd. in 2065 BS. A tenancy agreement was signed for 10 years.
Even though the tenancy agreement expired in 2075 BS, the Pvt. Ltd. had been refusing to vacate and return the land. In addition to the leased land, the Pvt. Ltd. was also using the additional land for parking, leading to a dispute between the two parties. After the dispute reached the District Court, Kathmandu and the High Court, Patan, the courts issued an order in favor of Scout.
Pvt. Ltd. had constructed a building on the land and was operating a party palace, hotel and restaurant. Following the court order, Scout had issued a 35-day notice in the name of the Pvt. Ltd. on 28 Mangsir 2079 BS, requesting it to vacate the land.
Since the structure is being forcibly removed without paying the remaining accounts and the decision of the Honorable Patan High Court and the repeated correspondences regarding the need to vacate the premises during that period, the notice states that the Pvt. Ltd. has been banned from entering the contracted area until the entire rent due to Nepal Scout is paid and the structure, whose contract period has expired, has been sealed for the time being and the remaining dues have been recovered and the property has been vacated by issuing a deed from the District Administration Office in accordance with the Local Administration Act, 2082.
