SP Awasthi of Cyber Bureau said that there is no law which says that those who make 'fake ID' will be punished. He said, 'There is no mention of taking action against making fake IDs. However those IDs can be turned off .'
Law professionals say that they can be taken under the scope of action under section 47 of the Electronic Transactions Act-2063 . According to advocate Praveen Bhatt, if a fake account is opened in someone's name, a case can be initiated under Section 47 of the Electronic Transactions Act. He said, 'Even if it is not mentioned as fake ID, the process of action can be taken forward by looking at the nature of the incident.'
According to Section-47 of the Electronic Transactions Act, if convicted in such cases, a fine of up to one lakh rupees or imprisonment for up to five years or both will be punished.
Section-47 states, 'Any person who publishes or displays materials that are prohibited by the prevailing laws on electronic media including computers, internet, or materials that are against public morals, decency, or materials that spread hatred or malice towards anyone or disrupt harmonious relations between different castes and sects, teases, harasses, insults, or does any other such unrestricted act. shall be punished with a fine up to one lakh rupees or imprisonment for a term which may extend to five years or both.'
