The ruling party backed away from the attempt to remove the 30-year service period in the police

What you should know

The ruling party has hesitated in preparing to amend the regulations to remove the provision of 30-year service period in Nepal Police. The government has backed down due to the delay in getting the consent from the Public Service Commission and the possibility of the decision being overturned by the court.

Inspector General of Police Deepak Thapa is going on retirement within a week. Before that, the government did its homework to remove the provision of 30 years service period in Rule 127 (d) of Police Regulations 2071. An official of the Ministry of Home Affairs said that the process did not proceed after seeing that the top leaders made such preparations but could not make it worthwhile. According to him, the was a that was prepared two weeks ago regarding the revision of the regulations, but the process was delayed because the government itself was not clear.

The opinion of the Ministry of Law is required to amend the Police Regulations, the most important issue is the consent of the Public Service Commission. If you send a letter to the public service, it will take a few days to get a reply, but the Prime Minister is leaving for China on Saturday morning. Therefore, the government is clear that there is no justification for this process," he said.

Inspector General (IGP) Thapa and Additional Inspector General (AIG) Dwaya Tek Prasad Tamang, Sudeep Giri are going to retire on August 18 due to the length of their service. Inspector General Thapa claimed that the issue of increasing the service period by amending the rules is not realistic.

He said that he will happily retire from the organization with honor. "It is one thing that the provision of services and conditions has been made by the parliament through the amendment of the law. Besides, I am in favor of the law. I do not think that I will be in the leadership unnaturally. IGP is the pride of the organization," IGP Thapa told Kantipur. But I am contrary to the values of the organization  don't know I am in favor of developing the career of those below me.'

The Supreme Court issued an injunction on 20 Chait 2070 against the trend of increasing the length of service in the police by amending the rules. In the mandate, it was said that the matters of service and conditions should be decided by the legislature (Parliament) and not be governed by regulations from now on. Even though the government took the police bill to the parliament seven months ago, they have not shown enough attention to finalize it. While the bill was under consideration in the State Order and Good Governance Committee of the House of Representatives, the government initiated the process of amending the regulations.

In the 'Nepal Police Bill' submitted by the government on 15th January 2081 in the parliament, the provision of retirement only due to tenure and age limit has been made by removing the 30-year service period. In the rules, the Inspector General of Police has a tenure of 4 years or 30 years of service or an age limit of 58 years, whichever comes first.

AIG and DIG have same age limit of 56 years and term of office is 5 years. The age limit of SSP and SP is 55 years and tenure is 6 years and 10 years respectively. Due to the provisions of the service and conditions laid down in the regulations, there is an allegation that the transfer, promotion, retirement and professional development issues are not transparent in the police.
